Are These Judges Internal or Foreign?

If that is the ruling principle during this Government – then the Dharmic (Righteous) move is to have a law that no Sri Lankan Judge could hold office in another country’s judiciary. Sri Lanka, which through its Constitution is committed to Buddhist pathway has the responsibility to ensure that the system of Karma is upheld in key aspects of  Governance. If the President expresses an opinion that he does not think it would be appropriate  to include foreign judges to make judicial decisions in Sri Lanka – then that is a political  opinion with no justice implications. To make a statement that the government would never accept foreign judges – is a projection of definite ruling. If this is undertaken then the balance needs to be maintained to rule out all Sri Lankans from holding parallel positions in other countries. Maintaining this balance of Equality is most important for us to have stable government.

When the culture is different - mind order is different; When the mind order is different there needs to be separation of powers so one does not interfere with another’s work pathway and system of faith. Minister Musthapha who continues to carry the qualification PC (President’s Counsel)  in breach of the Doctrine of Separation of Powers, is reported to have stated:

[Recalling the circumstances under which the then Chief Justice Dr. Shirani Bandaranayake had been impeached at the behest of President Rajapaksa, Minister Musthapha said that such actions caused rapid deterioration of judiciary. Regretting that he, too, had backed the impeachment of the Chief Justice, the minister said that remedial measures taken since the last presidential polls had helped improve the situation gradually.]

The change  at least at the level of this minister is more in style than in substance. In democracy – one must already confirm practice of a principle before proposing it to others. Without this mental separation between cultures – the minister is letting politics take over Administration. The dismissal of former chief justice will continue to happen in one form or the other when the status of such minds is elevated without connection to the root.

One is pushed to conclude that to this government – it is alright for legal qualifications earned in the past to be carried forward as is – by politicians but our heritage from other nationals is to be ‘forgotten’ now that the rulers are local only.  When we carry the value with faith as common owners – it is of heritage value. Such value is part of the structure but does not become active part of current merit. Separation of Powers helps preserve that heritage for the environment in which it was developed. This environment could be a discipline, country, province or even family with mother and father being Equal and Diverse.

Sri Lanka needs both – local investigation by the Government which was an active participant in the conflict. Ideally the judges at this level would be purely local with no foreign mind at all. That would then educate the Sinhala only and/or Tamil only learners. The International panel would in turn need to mandatorily include those who are legally not Sri Lankans but have invested in Sri Lanka for their global activities. Like auditors they do not have the mandate to punish directly through local laws and institutions but would publish judgments for global purposes – including for those Sri Lankans who are global minded. Sri Lanka used global resources to combat what it claimed to be Terrorism. It is now Sri Lanka’s turn to provide the return to that global community through the global pathway and not the local pathway.

The difference between the two judgments is the ‘gap’ between the Lankan mind and the Global mind. In Common terms it could be stated that the gap represents the difference in culture between  Service Provider and Beneficiary – due to lack of investment in global principles such as Doctrine of Separation of Powers. This could very well be on the part of the one with high status but unless we go through the process –we would not know whose mind is weak – would we?

UN Practicing Inequality?

‘On Sunday, I visited the Northern and Eastern Provinces, where I met the Chief Ministers and members of the Provincial Councils as well as the Governors, and yesterday morning I was honoured to visit the revered Sri Dalada Maligawa, or Temple of the Sacred Tooth in Kandy, where I was graciously received by the Mahanayakas (Chief Monks) of the Malwatte and Asgiriya Chapters. Sri Lankan Government is inviting the Public to make its contribution in structuring the new Constitution. Those of us who are not officially recognized make such contribution through conduct reflecting our Truth. Our Truth is often manifested freely when we are relaxed and feel unsupervised  by a person or by common law. Was the visit by the UN High Commissioner for Human Rights to Sri Dalada Maligwa confirmation of the UN’s Truth – that it continues to fail to address Inequality that exists due to Buddhism being attributed higher status than any other religion in Sri Lanka?  Does the visit not contradict the core message that the UN Human Rights Commission stands for – that in total value each individual is Sovereign and that where there are no common measures – as per common faith and/or official laws – we need to stay out of each other’s way  as Equal parallels?

The Sri Lankan visit by the UN High Commissioner for Human Rights, is an official visit and ought to have prevented any personal inclinations by the individual Mr. Zeid Ra’ad Al Hussein. The visit happened due to much pain and loss by all investors in Sri Lanka. Truth when manifested along a flat plane would show Equal sides. In Democracy these two sides need to be shown at the same point in time. UN’s commitment to Religious equality was not manifested by the UN High Commissioner for Human Rights. On the contrary – the visit confirmed lack of understanding of the root cause of ethnic war in Sri Lanka.

The root cause of the war is the lack of Separation of powers to the extent we are diverse at cultural level. Religion plays an important role in formulating our cultural norms.

The Root of the manifestation of an officer is the Common Policy. On that basis – the UN Officer had the responsibility to confirm the policy through Equal allocation of Resources to diverse manifestations. The absence of visit to Hindu, Christian or Muslim religious organizations confirms the lack of commitment to UN Policy in relation to Elimination of all forms of Racial Discrimination.

Natural Laws manifest the Sovereignty of Individuals and / or groups bound by Common Faith – where even one member is in need of such manifestation. In Sri Lanka this faith based binding is far stronger power than the bondage through legislated laws. Individuals and/or groups have the power to invoke the ‘balancing power’ of Nature / Truth once they become owners by feeling part of the whole – rather than thinking.

Given that  Buddhism is allocated an official leading position in the Constitution a Hindu who believes in Sri Lanka – taking the lower position would start contributing to the whole of Sri Lanka – much earlier than a Buddhist with higher responsibilities. I learnt this as a minority in Australia where Sri Lankan qualifications were considered to be of lesser status than Australian qualifications. I often took my lower position but continued to perform at the highest standard applicable in that structure. Once I completed my responsibilities as per my stated position – every stroke of my work went towards ownership. When I was persecuted for showing the outcomes of my contribution through my stated position – I felt pain which I had the duty to  describe as racism.  The official system did not recognize my conclusions – but the moment I gave it recognition – I started influencing the manifestation of Natural Powers of ownership. This resulted in the University of New South Wales as well as the then Prime Minister of Australia – getting demoted.

I identify with a similar pattern with minorities in Sri Lanka who feel Sri Lankan but are denied such recognition from time to time. Each time a Buddhist leader fails to uphold the leadership responsibilities as per article 9 of the Constitution – to contribute to the Sovereignty of Sri Lanka through the Sovereignty of Buddhism in Sri Lanka – the loss of ownership power is exponential – as if all Buddhists of Sri Lanka failed the ownership test. One who is truly sovereign would recognize another even though that other may carry a different form. The above visit confirms that neither the Buddhist Institution in Sri Lanka nor the UN Human Rights Commission is Sovereign.

Global Power v Local Power

‘Much of the Hindu epic, the Ramayana, is set in Sri Lanka. But the island has seen something of a modern epic in the past year or so, with the crashing fall from grace of the family which once appeared to run most aspects of life there. Once Mahinda Rajapaksa lost the presidency a year ago, his successor set about unravelling the network of power the Rajapaksas had built. In the latest examples, this week the former president's wife was questioned over corruption allegations, and one of their sons was arrested over suspected money-laundering, as the BBC's Charles Haviland reports.’

They say in Hinduism that the King slays (punishes) immediately but the Lord’s system waits and slays. To my mind, this means that where two cultures do not merge – the returns would come after natural separation of the two groups – each one being able to make the connection between cause and effect through their respective systems. If as per  Mr. Rajapaksa’s mind, when eliminating the LTTE, he was eliminating Terrorism – as defined by his People, and similarly – as per the LTTE – they were fighting to eliminate interference with Tamil freedom – then the it is likely that both would suffer Common pain around the same time. The two sides seem to be experiencing Common Pain as parents.

Mr. Rajapaksa’s supporters have declared:

"We have no faith in the police or the courts and that is why we seek the help of the gods to get justice,"

This is the People’s parallel of the Vaddukoddai Resolution which was hijacked by the LTTE.

If therefore Mr. Rajapaksa also acted as per his own belief in Natural Justice – then he would accept the pain of a parent just as Tamil parents are accepting. As per the above report:

[The United People's Freedom Alliance dissidents who support former president Mahinda Rajapaksa had organised an event on Saturday to dash 100,000 coconuts to invoke a curse on the government.]

A curse on the Government would be a curse also on the members of Rajapaksa Government included in the current Government – to the extent this  government is enjoying the fruits of the work done by the Rajapaksa regime. Likewise, a curse on the current Government would extend to Mr. Rajapaksa also if he was instrumental  in bringing the current government to power. This is explained as follows in the article:

‘The ritual of cursing involves dashing coconuts as well as grinding chillies, black pepper corns and ginger.   The grinding should be carried out with guidance from a temple employee. A slight shift of the grinding angle could mean the curse will befall the person casting the curse and not the “cursed” target.’

As per this report: [Seenigama  temple is possibly the only place of Buddhist worship where devotees seek divine help to punish people who had harmed them or stolen their property.]

Such reactions are not based on Lord Buddha’s wisdom. To my mind, Lord Buddha would have done his duty and let Natural Justice do the rest.

Lower Natural forces are animal forces and they can combine with similar forces to manifest ugly outcomes. The educated mind uses Higher Common Laws/Theories  to work out the connection between Cause and Effect so all practitioners would become one-minded. Majority Sri Lankans did not use this pathway but were driven by majority power  mixed with gun power. Once  brought to the lower level – the animal takes over the mind to produce physical level outcomes to ‘see, show and tell’.

This does not mean that the animal is unjust. Each species has its own characteristics. So long as it stays within its natural habitat – a species would not harm another unjustly. Hence the demarcations of Sovereignty. Once external assistance was had in eliminating the LTTE – the official  Habitat of Sri Lankans became the Globe and not just Sri Lanka. The battle now is between those global powers that possess that external power and are asking for their share of victory and the local representatives elected by the People. Those driven by the physical / majority power – would keep changing  the form of their expectations. Hence the expectation as per the Rajapaksa Government was expressed as elimination of  Terrorism. The expectation as per the current Sirisena Government is to ‘show’ elimination of  the Rajapaksa Government representing breaches of global laws. If Mr. Rajapaksa had not separated representatives of these global powers from the war zone – both LTTE as well as Rajapaksa Government would have continued to be in power.

The grave risk in Democracy is the intrinsic nature of majority power which is animal power when it is not rooted to Common Faith. It is the Common Faith that gives form to higher laws that would work for two or more relatives. Yesterday, a young local guy in Vaddukoddai – sought our blessings to successfully manage a public event. When we bless we bless our own investment in a junior. Likewise, when the junior seeks of her/his own free will – our blessings as seniors – s/he is blessing her/his investment as a senior. Hence Lord Krishna says through Bhagawath Geetha – that He is the Killer and that He is the one being killed.

The investment made by Sri Lankans in the system of Democracy through global laws is new, relative to their investment in their respective religions. When Tamils seek through their own religions – their inner Truth – that would free them from dependence on others – including to blame when something goes wrong. The more we ‘own’, the deeper we look within for solutions. That is real Independence. Once we seek and find our Truth as per the pathways in which we invested – outsiders are naturally separated from us – be it the Sinhalese or the Americans. Hence we need the acceptance that we killed and we got killed.  As a community we have enough strength to escalate the problem to the higher level – and we will become independent so long as we are free of majority power, weapons power and idle-welfare power.

Sri Lanka is Maatha to Sinhalese also

The weekend Nation article ‘Media depicts the animal in human’ by Arthur Wamanan and Dimuthu Attanayake extends also to Politics. An aging country driven by majority power brings out more speedily the animal in humans than a young country that Sri Lanka was in the 50’s.  It’s a natural process and unless overridden by stronger forces, would manifest the animal behavior.  One driven by Truth and / or Intellectual discrimination would lose consciousness of the majority power at the physical level and become independent of the body/land and use higher measures to live beyond local boarders of time and place.

The National Anthem of Sri Lanka being sung in Tamil also, on Independence Day anniversary 2016 - confirms that in terms of Politics, we Sri Lankans have a different mind order to the one that existed prior to 2015 – when the new Government was given birth to. The new Government was not naturally elected by Sri Lankans through their own free will. The voters were the messengers who wrote the message for Sri Lankans. The Sri Lankan National Anthem being sung in Tamil is the talk of the media here in Sri Lanka and in India. In its article ‘SINGING THE NATIONAL ANTHEM IN TAMIL’, Ceylon Today reports:

[The Tamil people too are Sri Lankans and they too deserve equal rights as the Sinhala people. If they are to feel the effect of the National Anthem it needs to be sung in a language that they understand.]

The author of the above article is confirming that s/he is yet to realize the value of Independence. To my mind, relative to Sinhalese - more Tamils merged with the British when the British physically departed almost seven decades ago. They completed the experience of British governance and their descendants yesterday celebrated that completion and not the physical departure of the British.

At the physical level – especially when ‘Sinhala Only’ rule was being introduced by short sighted Politicians, significant section of the Tamil community mourned the departure of British to whom Tamils were an important part of their investment in Ceylon. The real political ‘freedom’ for Tamils happened in 1976 – through the Vaddukoddai Resolution. Natural forces combined to confirm this Equal status through 1977 when the Tamil Political party became the Leading Opposition in Parliament. Vaddukoddai continued to sing Sri Lanka Maatha (Mother) in Tamil including through the Vaddukoddai Resolution. The strength of courage to do so had its source in British minds all over the world – especially in Malaysia & Singapore – which were a sources of Financial Freedom to many Tamils – especially to the architects of Vaddukoddai Resolution. It was therefore Vaddukoddai declaring its Financial Independence by going global. To majority Tamils – financial freedom is all they expect to live in harmony. To the extent the British system facilitated this – we are Common owners of each other’s Nation. Nation is not limited to Land alone – but to the higher minds and common policies.

The Tamil version of National Anthem being sung by students confirms that the main avenue through which this financial freedom is achieved by Tamils is Education. In many ways the aridity of Northern Province left us with lesser choices than the Southerners had, to earn a living. Given that the system of education continued to be based on British structure – our investment in education was real celebration of financial freedom through British investments.

It is therefore valid to say that we were as ‘free’ as the British to the extent we included them in our living. In contrast, Sinhalese who have the responsibility to Administer the whole – depended largely on ‘majority’ rule. They thus replaced British Rule with Nationalism Rule to ‘look’ good to the voters. Voters becoming the bosses of Politicians is reflected down the line as employees becoming the bosses of employers and customers becoming the bosses of suppliers and at family level children becoming bosses of parents. That is the way of those driven by the physical. That’s when reverse discrimination happens – as confirmed by JVP in South and LTTE in North. The greater the hearsay knowledge / copied information – relative to the earned knowledge – the lower the mind order. An extreme example of this is Australian Julian Assange of WikiLeaks.

As emphasized recently to our students in Vaddukoddai - the order in which we organize data that is raw material to the computer determines the quality of the root of outcome which becomes the causal force for the next phase. Hence the dictum ‘Rubbish in Rubbish out’.  When we arrange our position relative to the person we are learning from – the Root Cause/Energy flows direct from the Guru to the Disciple. Many British minds would have thus been placed in Ceylonese (Tamils included) through the Education system. At our Institute of Chartered Accountants of Sri Lanka – we learnt largely through British order. 04 February is therefore Memorial Service by those who continue to carry that order.

The greater the dependence on Majority Rule – the lower the mind order. The lower the mind order – the greater the dependence on ‘external influence’ – even if they are our juniors – especially our juniors -  if we stay on as one unit and the juniors are physically and/or financially more powerful than us and are unable to limit themselves to the former level of the senior to become Equals.  This is the risk Sinhalese face without Tamil opposition – and hence tending towards higher status than British from whom they inherited a large percentage of the global/international section of the current system.

Minorities/juniors in turn can only be Equal to majority / seniors of the completed whole. Where minorities / juniors claim victory over majority/seniors and show off – we are declaring that we are guilty of plagiarism and invasion into other’s area. That was how the Tamil community allowed itself to deteriorate and become of the mind order of the Sinhalese who are dependent on votes. The Politician on her/his own may not be independent of the voter. The victorious politician would be. But by recognizing within her/himself the truly independent Governor through the system of Truth – the Politician prevents her/himself from  spending most of her/his time in government as a Politician – as Mr. Rajapaksa did.

We have the god as well as the animal in us. When our brain is programed through our inner Truth – the god in us leads and guides us. When we are idle and take the easy path of majority – the old animal listens to her/his master’s voice – the master being the voter / junior. That is how we lose our self-dignity once we step into positions we did not earn. To claim independence from the British – we need to have renounced all benefits from the British and started from zero base. Truth takes us to this neutral position. The benefits so renounced become the structure we start with – as British Heritage we have rightfully earned. That would naturally match the heritage that the British carry of Ceylon. They have the natural right to confirm that heritage without activating it in their current structure and v.v.

One to whom Sri Lanka is Matha / Mother – has the intuitive power of ownership. This could very well be Tamils who have absorbed the pain of loss of loved ones and hard earned and saved property. THEY are the ones who would confirm who the father / political ruler is. At this point in time – Tamils who have suffered more as Sri Lankans than any other race in Sri Lanka have the realized Right to sing their National Anthem in their Mother tongue. It is the lullaby that postwar Sri Lanka needs, to comfort herself and develop on the basis of her own Truth – that excessive freedom brings out the animal in us.

Rights like God – exist naturally without form. Only rights that are realized qualify to be expressed freely without higher authority. This time it is the turn of Tamils to lead that expression of rights and not be the tail end of Political shows.  We have the right to say who the father is – whether it is  the Global community which includes the British or the Sinhalese majority which include the Rajapaksa regime that manifested far more political outcomes than it had the right to. Sri Lanka means different values to different investors. All genuine owners will naturally respect other owners.

Are we truly Independent?

Today Sri Lankans officially celebrate Independence from ‘foreign rule’, claimed to have been obtained after 133 years. The question that comes to mind is whether we are truly independent ? Independence is Independence. At the deeper Common level – it is independence from the past. On 03 February 2016  the Government reveals its mind as follows through article headed ‘Largest Buddha Statue in Abhaya Mudra to be unveiled on May 19’:

[The largest Buddha statue in a standing posture planned in the Southern Province since the time of Sinhala Kings has been completed by a team of sculptors at the Wathuruwila Wanawasa Sangha Centre (Mulasthanaya). It is due to be unveiled by President Maithripala Sirisena shortly.

This Buddha statue carved on stone was first conceptualised by the founder of the Wanawasi Sect, Ven. Wathuruwila Sri Gnanananda Thera.

Following his demise in 1986, the onus of making this a reality devolved on the Viharadhipathi of the Wanawasa Sangha Centre, Ven. Mahakande Ratanapala Anunayake Thera of the Wanawasi Maha Nikaya.]

While the above may seem to be an act to preserve the Buddhist heritage in Sri Lanka, to the real victims of war – it would seem like a Victory Celebration due to the choice of day for the opening - May 19 – the anniversary of the  day the Rajapaksa Regime claimed to have defeated Tamil Rebels through use of their armed forces. As per my discovery – all manifestations have causes at three levels:

1.      Surface level through brawn power

2.      Intellectual level through Common Mind

3.      Force of Truth as per the Lord’s Creation (for example those we call Acts of god)

Once we are truly Sovereign/Independent of the past and/or the present – we would identify with the pathway of Truth. Until then we need Relativity to live in harmony. Hence the use of Laws common to all in a particular environment.  Conscious Seeking of  Independence helps us to develop laws for our followers – conscious or otherwise. If our Destination is Truth – the pathway is that of  Natural Justice. Every person/group  reaching this Destination is naturally empowering the place and time of such work and sacrifice that went towards reaching this Destination. If such was through Sri Lanka – then today we celebrate those contributors also – even though they may not have been  born in Sri Lanka and / or be legally defined as Sri Lankans.

If we truly became independent 133 years ago – we would not have any mental disturbance over the 30 year war – nor would we keep activating it in a country where thousands continue to carry fears and anxiety of suppression by brawn power. Surface memory / copied information is part of brawn power. Hence plagiarism is a sin for any person who is part of a University. Without Research and Discovery of the connection between cause and effect – there is no valid claim to University status. If  Tamils as a community contributed to Sri Lanka becoming of age 133 years ago  -  and they did this as Tamils and not as Common Ceylonese – then their continued struggles against Takeovers through ‘Sinhala only’ and Generalization through blind application of  the Secular law – are confirmations of the contributions made in the past. When the current activation is beyond the investment made by a person/group in Independence – it brings the mind order close to Brawn power driven by surface memory.

When one or more  members of the victims’ group absorb the ‘mistakes’  by the Government – so there would be harmony in the environment – and stability in the development of  reliable structures that would represent our Truth, such member/s develop ‘intuitive’ powers of mothers. They quietly influence through the minds of those they have included as part of themselves to cure and to protect the whole. Such intuitive power also manifests ‘Acts of god’. As per my discovery God does not act except in human form. We draw on the power of Truth within, to which we add another human’s Truth through our own Truth. It is easier for genuine seekers to develop this Soul Connection with those who are biologically related to them. But that relationship must end within the physical borders and not taken beyond – if we are to combine forces with others to have the  Global experience of Independence.  

The recent arrest of the son of the immediate past President – Mr. Rajapaksa confirms the risks in such continuity beyond local family borders. LTTE leader also was guilty of such extension. They both carried the past as is – beyond their ‘use-by dates’ and hence the return karma through family pain when the system changed to lateral democracy.

The discovery about rebirth is that -  we do not remember the past – be it seen as good or bad  but we could work out the essence through our genes. Celebration of Buddhism on a day when the Tamil Community’s defenders of Freedom were seriously wounded and/or killed is confirmation that the Rajapaksa genes are being carried forward by those who claim to be Buddhists. They have picked up the left overs of those who rebelled / terrorized without deeper cause – in a new environment – centuries later. Buddha’s name is being used in vain to show off such ‘cleverness’ in the past.

When physical power is exercised to express one’s investment in independence – and is so done to prevent damages to that investment it is Rebellion. Without this deeper value – every action to suppress another is Terrorism. Once expressed they qualify for visible punishment.  Every thought of such suppression – suppressed to avoid punishment - deteriorates the thought order of the mind. When left unaddressed by the self and/or by someone who includes the person as part of her/himself – it becomes negative karma / genes – which are beyond the influence of current measures of merit.

Becoming independent of the Past also makes us independent of the future and helps us live in the present. Every moment we live in our Truth and Truth only – invokes the Sovereign / Soul power that all of us are born with. The place where we so discover the Truth is naturally empowered and is sacred. If majority Sri Lankans of current generation - seek to remember May 19 – it must be openly facilitated through relativity. Tamils who genuinely lost more than those who celebrate May 19 but quietly absorb the loss because they feel part of the whole and its structures for the next generation – would carry the intuitive power to work Sri Lanka – the real Sri Lanka which includes those who are not biologically or legally part of Sri Lanka. The Sri Lankan body is limited to the land. The Sri Lankan mind has the capacity to make the whole world Sri Lanka and v.v. Some of those minds are called British. But to the extent they realized independence from their past through Sri Lanka – there are no borders for them nor for those of us who recognize them as such. It is strongly possible therefore that there is a large doze of that in the arrest of the son of the former President. This may be needed to prevent ‘take-over’ of the whole through armed foreign powers living off  by their past status. Today’s arms is information – as used by Channel 4 of Britain.

[Chief Prelate of the Malwatta Chapter Most Ven. Tibbatuwawe Sri Siddhartha Thera says instead of trying to bring amendments to the existing Constitution, the government should look to introduce a brand new Constitution by dispensing with the Executive Presidency.
The Thera also stated instead of attempting to formulate a Constitution in secrecy the government should seek the views of the people when drawing up a new Constitution.]

The system of Democracy recognizes the rights of the Citizen and the Public Officer to be Equal. Given that the Public Officer by law has higher status relative to the Citizen – the Citizen is taken as right until proven otherwise. Likewise, the Customer. This Equal footing is the platform on which Democracy would work.

The Constitution is the Soul of the Legal & Administrative systems. If the Government does not already know the Belief of the People through elected representatives – then it disqualifies itself as Democratic Government. Seeking the views of the People – for political purposes needs to expressly exclude voters without demonstrated contribution to Law and Order – at individual and/or institutional level. Such voters are limited to votes to elect Government  and need to be excluded from direct participation through majority rule again and again.  

If majority opinion is the body, the source of  intellectual discrimination is the deeper brain. That deeper brain recognizes that Truth when manifested through a common measure / a still mind – divides Equally along that plane. Where the system of measure is Democracy – the lateral plane is used and the two halves are seen immediately and time is frozen. Where the system is Autocracy the vertical plane is used and place is frozen.

As per the above report:

[The Thera made these remarks when senior counsel Lal Wijenayake and a group of representatives called on the Chief Prelate at the Malwatta Temple yesterday (1). Wijenayake is the Chairman of the committee set up to seek public views on the formulation of a new Constitution.]

Given that no minority religious leadership’s Blessings  is reported to have been sought by the Senior Counsel Lal Wijenayake one concludes as per the deeper brain – that the system of Autocracy has been followed by this team.

The Law may or may not lead to the Truth. A law born out of the Truth of the person / place would naturally lead all those who believe in that person and/or place - to Peace. One believing in Lord Buddha would reach the destination of Nirvana – another name for Truth.

If we are true to ourselves we would know that the current Constitution is to uphold Buddhism as the foremost religion in Sri Lanka. This is best represented by the Presidential system and not by a flat democratic representation. This means also that non-Buddhists in Political environments would not think they are equal until proven otherwise. Merely stating that we are all equal – amounts to lip service. To state that the opinion of the Public must be obtained is to add insult to injury.

Where we need our past for our current operations – we an autocratic system – based on time – i.e. – the costs were paid in the past and the benefits are expected in the future. Where we do not need our past to be operational – we would naturally follow the system of Democracy. Computer  for example could be a trading stock or an asset. One who ‘shows’ it as an asset / heritage – should not try to sell it as ‘trading’ stock. To the extent we receive benefits on the basis of commitment to Democracy – we need to not use our past achievements to earn credits with donors/customers. If we do invoke the past – our mind order goes to the past and in Sri Lanka we could expect the turmoil of the past to be activated with such mind order – especially when the other side is also look for a fight to show its cleverness – as the LTTE did.

As per the above report the Buddhist Leader [also pointed out that if the electoral system is introduced then politicians will not be able to shirk their duties towards their respective electorates unlike at present when they are not so answerable towards the people in their electorates.
The Chief Prelate also stated that the public have shown much enthusiasm in giving their views to the committee mainly due to the shortcomings visible in the existing Constitution.]

I have shared my Truth as a Sri Lankan, towards a more democratic Constitution. Until there is Equal and Opposite manifestation from the Government it is wasted on the Government. But Truth is Universal and hence my contribution would travel beyond Sri Lankan borders to become global and/or remain in waiting – to be picked up by future generations. The current government is seriously lacking in wisdom in Equal Opportunity principles. I therefore conclude that the next Constitution by this team that has given preference to Buddhist blessings would continue to be vertical in its conduct and therefore a continuity of the immediate past government once the eyes of the global community’s wallet are turned elsewhere.

Tamils would be better off investing in Business Opportunities independent of the Government but ensuring that the laws as interpreted by them are followed. There is value in genuinely following the Common Principles and Laws. They open the doors to ownership as per our genuine investment in the laws at least to the extent of our knowledge in our current environments. If the return for the Tamil vote is expected to be handouts – then we would have repeats of the past. A clever worker would instead use the little raw material / policy s/he has and add fill the gap with current work. The best avenue I see towards this for the Jaffna man is Business basis. We are already practicing it here in Vaddukoddai.

As per Hindu depiction  – Brammah the Creator is from the naval of Lord Vishnu. This to my mind, means that Brammah gives biological form to the Soul.  If Sri Lanka as a whole is Vishnu – the Constitution is Brammah.  Lakshmi – the goddess of wealth  is at the feet of Lord Vishnu as well as in Vishnu’s chest. This to my mind means that by being humble to the Common pathway (the feet) – of the whole – we would earn to be in the heart of the whole.

With that belief – if we Tamils who have invested much in Equal Rights need to find the appropriate level at which we can function independent of  Government but within the pathway of the whole. This would be the Business pathway – including at Public institutions where the member of the Public is treated as an Equal to the serving Officer. Recently – at the Jaffna Kachcheri – when I went to register the power of attorney given in my name by my brother – the front office person ‘told’ me not to keep my papers on top of his files but to keep them on my lap. He then told me that given that I was not living in Sri Lanka that Power of Attorney was not valid. I informed him that that was not my understanding of the Law. I asked him to show me the rule in print. He then asked me to speak to the Assistant Registrar General. That lady said to me that as per the Power of Attorney I was ‘currently living in Australia as well as Sri Lanka’ and that could not be the case! I said ‘current’ covered a period and not just that minute. When I asked her to show me the law – she said to register it in Colombo!

This ‘telling’ happens more amongst the Judiciary in Australia than the Administration. I note this pattern in Sri Lanka too. One who treats the member of the Public as an Equal until known otherwise – is already a member of the system of Democracy. Others are continuing to use the remains of the old system.

This lesson is the parallel of the blessing by the Buddhist clergy – so the demon of inequality would lose at least a little power.

Which Law do I need?

It’s my Mum’s birthday today and I decided to Experience my mother at Selva Sannithi Murugan Temple in Northern Sri Lanka. It was at this temple that my father was informed by the priest on a Friday that a new being was joining our family.  Even though my Mum did not know it at the time of announcement – she was pregnant after 13 years. Our  brother’s arrival was announced by the priest who did not know us as individuals. To my mind, it was confirmation of my father’s faith in Lord Muruga and my father’s commitment to due religious processes as he knew them through practice. That day my father stood outside the temple because he had not had a bath. The priest who performed the ceremonies with his mouth covered – blessed my father with holy ash and made the announcement.

Relative to many in our family – our father was not a high achiever. But my father had deep faith in his ancestors as well as in God. My father did not know the law through formal learning but he knew logic. To my mind, my father had confirmation that day that the Lord had heard his prayers for a son.

My mother shared this wonderful experience with us and in turn I shared with those of common faith. Out of the devotees present at the temple today, one guy kept lamenting and I felt that he had lost a loved one in the war. The Temple is not too far from the birth place of LTTE leader Velupillai Prabhakaran.  It was therefore possible that the lamenting guy had become a victim of war due to being a local.

Living in Thunaivi – a high risk zone – I realize more and more that these guys do not know most of the laws but are driven by habits. Left to themselves they usually do not bother others. The educated upper class therefore became ‘outsiders’ to these groups. Separation of powers between the educated and those seeking to win through armed power did not exist. Had it existed – the two would have run parallel and the leaders answerable to their respective members. We then would not have had the war. The two were mixed indiscriminately in breach of the fundamentals of the Doctrine of Separation of Powers. Where the armed group is not ready to submit to the educated group and the latter’s conduct  is visible to the former – the root of the hierarchical structure is damaged and the two become outsiders to each other. Politicians ‘buying’ votes one way or the other – contribute strongly to such Natural Separations. Where the two are separated – each managing its own members independent of the other – the risk of conflict is seriously reduced. The LTTE thus had the right to declare that they were representatives of those who relied on brawn power above brain power, provided they believed they were natural members. They did not have the right to represent the educated section on the Tamil community. Likewise, Politicians who turned a blind eye to the law but used outcomes – over which they had physical control did not have the right to claim that they were representatives of the educated sections of their community. To that extent the CITIZEN who practiced the law above them was ‘free’ of the politician. The Administrative position occupied by the Politician is in Trust and the Free Citizen who actually practiced the law covering that position is the higher owner of that position. Others may not recognize this right – but the Truth in all investors in that position would render inner satisfaction to that practitioner through Natural Justice. This is why Truth is important.

IN their article ‘Responsibility, Autonomy and the Geneva Resolution 2015’  at http://www.dailymirror.lk/104729/responsibility-autonomy-and-the-geneva-resolution-2015#sthash.lQHJWjqn.dpuf, the Friday Forum states:

 ‘The joint resolution is a reminder that truth-seeking and justice, however complex, ensure social integration, and that their absence is detrimental to civic order and the Rule of Law.’

Truth is available to all due to the laws of creation. Once discovered – the discoverer becomes natural member of the group that uses the particular pathway. The above article for example – is reported to have been written by Bishop Duleep de Chikera and Professor Savithri Gunasekara. As per their titles – they represent two different groups/electorates. The Friday Forum on whose behalf they have written is described as follows:

[The ‘Friday Forum’ is an informal and self-financed group dedicated to democracy, good governance, human rights and the Rule of Law. It has for over five years sought to alert the public on issues concerning the rights of the citizen. We work on a non-partisan basis and have been critical of both the Government and Opposition.]

As per the LAWS of Democracy – only an elected member of Parliament has the right to lead citizens in Political Governance. One who is a leader of certain section of society - through a formal pathway does not have the right to directly access the citizen about Political Governance while carrying the titles of officially representing  a particular part of society – Catholics in the case of Bishop and Academics in the case of Professor. Doing so is in breach of the Fundamentals of Separation of Powers and amounts to INTERFERENCE. The mind of the voter thus is torn between two faiths for the same issue. The highest example is the Chief Minister of Northern Province – Mr. Wigneswaran who carries the title of Justice. Such persons confirm living off the PAST – and therefore do not have the current Experience through their current positions. Attachment to outcomes through the past while being currently active in a different pathway – leads to INTERFERENCE – the very wrong that politicians in Administration are often guilty of. INTERFERENCE  is damaging – irrespective of whether it is by the Politician or by the Religious Leader or the Academic. They damage the Sovereignty of the respective units that together naturally group themselves as the Sovereignty of the Nation.

The test of effectiveness is known through the question -  whether the laws as known to this group – would lead the general Public  to Truth and Justice? This group may find their own Truth but would that be in the same form as the Truth discovered by those who have had the Experience ? The pathway through which we travel shapes the form given to our discovery. How can a person of Thunaivi connect to the Truth discovered by say Professor Savithri Gunasekara – an expert in using the law intellectually to get the ‘right’ grades. As per my understanding  a University’s core activities are Research and Teaching. What kind of Research went into the above article to identify with the Truth of those who have had the Experience? If it is largely academic – then – it would certainly not contribute to those who do not have high level of formal education.

In Thunaivi where the folks do not know about my past – except that I am Australian Tamil – I have drawn the line of separation between private and public – so we could move into Business-mode to ‘show’ outcomes independent of each other  - instead of enforcing our ways on each other. The People of Thunaivi understand the language of money and therefore Business. Hence this move which goes towards the Government’s own pathway of moving towards Business Unit approach in Public Administration. But I had to sacrifice deeply towards knowing where to draw the line – so the less educated would not take the law into their hands as per the example of the LTTE which has been accepted by Tamil Political Leadership. When I said the water well was our private property – they said they knew that but they did not have wells of their own! I said if they were using our well they needed to follow the rules that I have set down – and that is not to use it for lesser purposes – to tease the girls and to show that they were the leaders in that area. They are not overly concerned about the Police who seem distant to them. It is also not fair in my books to go to the Police over whom I would have greater influence than these folks, except where I am physically attacked. Instead I used the Australian Immigration name tag issued during the conference about Illegal Maritime Arrivals.  I pointed to that name tag and said that if they acted in breach of my rules – they would be reported to Australian authorities – who would maintain files and use them against such youth if they were to come to Australia. Given that most of them like to go overseas for better living – and quite a few go to the Middle East – they started dropping off from this habit of ‘unofficial’ political grouping. Instead they went to the next property which did not have direct supervision by the owner. This does not have a well but the property was used to stage their music loud and clear. On 14 January 2016 when I came back ‘home’ after training young ones at Vaddukoddai – it was this loud music that welcomed me. I was neutral to this who of ‘local authority’ but went about completing my night duties and went to sleep. The following morning I woke up early as usual and meditated. I thanked my parents and ancestors for maintaining the tradition of Pongal at the temple – so I could continue to develop the heritage for my own children – biological and social. I especially thanked my mother to whom this environment would have been very different to the one in which my mother was groomed in Burma. The success of my parents’ marriage was confirmed through such continuity. I then started getting ready for the Pongal celebrations to be held later that morning.  But the music started again and it was not Pongal music. It was mostly cinema songs which would have been disapproved by my parents. This was new ‘interference’ and I just could not take it. I rang our coordinator around 5 o’clock and announced that the Pongal celebrations were cancelled. I went over to the temple where one youth who was part of the music team was sleeping – as if the temple was his bedroom. When I shouted at him he got up and said that their group  would do the Pongal for which I had declined permission on the grounds that only families were allowed as per our rules. When he tried to ‘explain’ I just left the temple and went to our cottage. I got dressed in black – like the guard dog representing Lord Vairavar - rang my husband up who was in Sydney and then went out to the temple – ready to physically prevent any Pongal by the youth group. I paced up and down for hours. The youth carried on playing their music – as if nothing was amiss. Folks around the temple came to their gates and looked on – without one of them joining me. THAT confirmed the separation. After a long time one guy who gets employed by us from time to time came over and ‘waited’ close by. He slowly asked me what was wrong!  When I explained that the music was loud and not religious – and that the young ones had sworn to do the Pongal despite permission being denied. I pointed out to the guy that two of the group were his sons. The guy quietly left the place. Later I learnt that his sons did not hesitate to hit their parents – confirming the cultural gap within Tamils.

One side of the border of the property used by the youth group is that of the TNA (Tamil National Alliance)’s legal representative Mr. Kangeswaran’s.  It was like a totally different world on the other side of that wall. The laws used by Mr. Kanageswaran did not apply to these folks. The TNA participates in high level negotiations regarding Land occupied by the Government – while their own backyard in Vaddukoddai is abandoned to cultural ways to be used as laws.

We did not have the Pongal but the priest – Radha Aiyar came voluntarily to perform the poojah. Pongal festival is to thank the Sun for a good harvest. As I explained to some who did ask me later – the Pongal ceremony at the temple was confirmation of our family’s investment in Common work and structures. Damaging that heritage was a sin. The mother of one of youths said I could have still had the Pongal (Boiling of Rice in Open fire) – but I declined – as if would have amounted to hypocrisy. Instead I upheld the Truth I got to know as part of that community.

Within me I cried.  On my way to the Railway station I went to the Church that my mother prayed at when she heard that her baby was in breach position. When the Baby was finally born – it was through ‘normal’ process and my mother said ‘thank you’ to Our Lady at that church – at 4^th Cross St - for a long time. I went to that church and there waiting for me was Pongal – Sweet Rice by workers at the Church! I melted – knowing Mother was blessing me. Later  I took some photos of the home near by at Martyn Road – in memory of that miracle and the sacrifices my mother went through to deliver and groom not only our brother – but all three of us – independent of family support.

No Law officer was there to support me but my Truth – particular to our family and its independence – was there for me to invoke. Wonders such as the above are our own endorsements of membership with the system of Truth. Each one will receive that confirmation as per their own pathway. The secular Law – be it local or imported – is often not accessible by the ordinary folks. But the Truth is always there to show us the way that suits US – so we do not interfere in others’ pathways. Where we have to share for certain purposes – we need to publish our Truth independent of the other and REMEMBER that the other areas is NOT ours. Where for purposes of work – we have laws to follow – both sides must be facilitated to produce their Truth to a Common source that would merge the two and form the Common Law through which we regulate our conduct while in common areas of Administration. The role of the UN is to develop that  Common area. It should not produce any discoveries of its own about Sri Lankans. It must convert all its investments in Sri Lanka to take up Observer status – instead of being a participant. All those who have benefited including through Business and Development opportunities – do not have the right to approve or disapprove at policy level. This includes India as well as America. If UN also confirms benefits – then it is left to Sri Lankans to find their own Common leader driven by Truth – as India found its Gandhi. 

The pathway to the Truth is the highest law to each one of us. All just laws would naturally merge with them or run parallel to them.
