DOES INDIA BELIEVE IN IN SRI LANKA’S 13TH AMENDMENT ?

Belief is essential for making laws including for ourselves as individuals.  Where we make laws that are binding on others – it is essential that we believe in that group and that we believe in the laws that we make for the ‘group’. When these criteria are satisfied, the law works and spreads itself exponentially.

More importantly, we the lay folks, need to know through our previous experiences, that our belief is part of the manifestation.  Then we will identify with the manifestations of our belief in our own home environments.

If we seek to participate in outcomes that are delivered beyond our local home environments, we need to share our beliefs, with the broadest home group that we feel part of.

This is the basis of Resolutions at UN level.

The Universal test of belief is that we would find perfect logic in the manifestations. Those of us who use the causal pathway would know when we share/contribute,  that there is Equilibrium  between our inputs and the outcomes projected by us.  As a Sri Lankan my belief in the UNP was thus shared through my article ‘UNP Blessed in Northern Sri Lanka’ dated 15 August 2019, during Nallur festival. http://austms.blogspot.com/2019/08/gajalakshmiparamasivam-lord-nallur.html

Even when the UNP lost in the Presidential Elections later that year, I did not lose interest. Likewise, in the 2020 Parliamentary elections. As one of my followers confirmed recently, the contribution was ‘received’ by a higher level. This in this instance was the UNP as a party from inception. The actual manifestation happened in 2022 with Mr Ranil Wickremesinghe becoming PM first and President next. Now he gets to pay our respects to honour the Queen also.

As per the Sunday Times Political Editorial ‘Toughest-ever UNHRC resolution against Lanka’ at https://www.sundaytimes.lk/220918/columns/toughest-ever-unhrc-resolution-against-lanka-496095.html  :

[In this regard, the Indian delegation notes with concern the lack of measurable progress by the Government of Sri Lanka on their commitments of a political solution to the ethnic issue through full implementation of the 13th Amendment of the Constitution, delegation of powers to Provincial Councils and holding of Provincial Council elections at the earliest.

“India’s consistent view on peace and reconciliation in Sri Lanka has been for a political settlement within the framework of a united Sri Lanka, ensuring justice, peace, equality, and dignity for the Tamils of Sri Lanka. The current crisis in Sri Lanka has demonstrated the limitations of the debt-driven economy and the impact it has on the standard of living.

“It is in Sri Lanka’s best interests to build the capacity of its citizens and work towards their empowerment, for which devolution of power to the grassroots level is a prerequisite. In this connection, the operationalization of Provincial Councils through early conduct of elections will enable all citizens of Sri Lanka to achieve their aspirations for a prosperous future. We, therefore, urge Sri Lanka to take immediate and credible action in this regard.”]

As per my belief, it is the belief of Colonel Thileepan who died of injuries in the battlefield . The death happened at Nallur Temple grounds, confirming to us fellow believers in Nallur Murugan, that Thileepan believed that he was fighting for independence. Given that as a civilian his home area was North – that discrimination he fought against was caste based and NOT race based. The former would be the basis of his belief and the latter, his thought only. The form was as outlined by rebels in his environment.

By surrendering to Nallur Murugan, he raised the manifestation to the highest level achieved by the Common Believer in Nallur. I sent an open message in 2009, for the LTTE leader to surrender to Nallur Murugan. Given his lack of belief, he did not receive that message. But Thileepan the Tamil Ancestor would have.

The demands made by the LTTE through Thileepan were already part of the the Indo-Sri Lanka Accord on 29 July 1987. This accord was the basis of the 13th Amendment to the Sri Lankan Constitution – passed by the Sri Lankan Parliament on 1 November 1987.

The contributions by various parties is presented as follows:

[ As hostilities increased in northern Sri Lanka, the LTTE handed over a letter to the Indian High Commissioner on 13 September 1987 making five demands: the release of all political prisoners held under the Prevention of Terrorism Act and emergency regulations; cessation of Sinhalese colonisation of Tamil areas under the guise of "rehabilitation"; cessation of all "rehabilitation" activities until the establishment of the Interim Administrative Council; cessation of construction of police stations in the Northern and Eastern provinces; and the disarmament of Home Guards and withdrawal of the army/police from schools and colleges. The demands were aimed at the Indian rather than the Sri Lankan government because the LTTE believed that Indians could force the Sri Lankans to comply. The LTTE gave the Indians 24 hours to respond but no response, or even an acknowledgement, was received] Wikipedia

Thileepan passed away on 26 September 1987.

The original Political Structure of Tamil Nationalism was declared by Tamil Political Leaders through the 1976 Vaddukoddai Resolution. These leaders were mentally eliminated by the LTTE who did not pass their demands through the Political leadership. To my mind they did not believe in the Vaddukoddai Resolution, nor Nallur Murugan.

LTTE was pushing for the parallel of Buddhist Nation which was established through ‘Buddhism Foremost’ article in the Sri Lankan constitution. Those who failed to officially Oppose this, will not be able to work devolution.

As per Wikipedia:

[In February 2016, the Chief Minister of Sri Lanka's Northern Province, C.V. Wigneswaran sought India's direct intervention in the complete implementation of the amendment]

If Mr Wigneswaran had actually believed in the essence of the 13th Amendment, he would have continuously opposed breaches of its provisions by presenting Bills to further amend the Constitution to be in line with Sri Lanka’s needs and not India’s thoughts.

Those who follow the LTTE would not be able to work the 13th Amendment due to their belief being Tamil Eelam – the Separate country. The LTTE did not have the belief based Jurisdiction in Sri Lanka. Hence  Mr Wigneswaran and others like Mr Gajendrakumar Ponnambalam who openly claim to follow in the path of the LTTE – with or without arms.  Belief based armed rebellion is non-violent – for it would be only to Defend.

PROTESTORS MADE SRI LANKAN HERO, A ZERO

As per my experience based discovery, when we live by our truth, we can never fail ourselves. Others may mark us wrong but ultimately we are driven by our own truth. Some of that truth is discovered through current theories and laws. The rest is that which we call karma.

The role of the media, is primarily to report ‘what happened’ and secondarily to share its own truth. One of my readers who identifies with the latter, forwarded an email headed ‘Protesters and the Law’. Attached to it was the unedited version of the article ‘Aragalaya’s Fundamental Right farce: When lawyers distort facts’ at https://www.sundaytimes.lk/220911/sunday-times-2/aragalayas-fundamental-right-farce-when-lawyers-distort-facts-494666.html

The author is H.R.H. Amarasinghe, Convenor, Citizens Collective for Law and Order.

It was fulfilling because much of it was already covered by me, as I experienced what happened. It felt good to know that there were others who also had the courage to publish the truth.

As per the published article:

1.  [Presidential Secretariat

This building was occupied forcibly by Protestors from July 9 when they broke through the barricades erected by the police and gained entry after Gotabaya Rajapaksa had left the country. They also entered the President’s House, Temple Trees and the Prime Minister’s Office, overpowering the Police guarding these state buildings.]

Transparency of outcomes is essential in Democratic Protests, as it confirms courage needed to oppose. If the above is factual, and the ‘gained entry after Gotabaya Rajapaksa had left the country’ that delay confirms ‘fear’ of the then President. If there was no desire, there would be no fear. Hence one is entitled to conclude that the Protestors lacked Governance power to Oppose.

2.

[The original protest site was the Galle Face Green which was where peaceful protestors had gathered. However, after July 9, protestors had taken over the Presidential Secretariat even though the objective of their protest #Gotagohome had been achieved.]

The above confirms that the original protestors did not express their truth or that others with Political interests had hijacked the Protests. A protestor has to be self-governing and hence identify with the stated outcome when achieved.

3.

[These locations were distinct and separate from each other due to the widely differing nature of the sites and the purposes they were used for. The Galle Face Green could be considered  a public space often used to stage peaceful protests. The Bandaranaike statue and the Presidential Secretariat were on the opposite side of the Green across Galle Road next to each other. Anyone attempting to lump these three locations together and create the impression that it was one site is guilty of a gross misrepresentation of fact designed to deliberately mislead the public.

4.

APPLICATION OF THE LAW TO THE FACTS

[ Galle Face Green

The original site where the Aragalaya started and was considered the designated protest site was not attacked by the security forces. In fact, video footage is available of Police asking those occupying the Presidential Secretariat to move to the Galle Face Green as occupying the Secretariat was an offence. The two major independent news channels, Derana and Hiru, while giving extensive coverage to this event refer to the Presidential Secretariat being cleared of occupants. There is no mention of protestors on the green being attacked.

However, references have been made consistently and continuously by lawyers and civil rights activists to peaceful protestors being attacked or the protest site on the Galle Face Green being attacked. The Galle Face Green was the only site where protestors could have been considered peaceful and references to peaceful protestors being attacked were designed to deliberately create the impression that it was those on the green who were evicted and therefore there had been a violation of their Fundamental Rights.]

5.

[On July  10, the leaders of Aragalaya  protestors   held a press conference where they stated their intention of occupying the Presidential and Prime Ministerial Offices and residences until the President, the Prime Minister and the entire Government resigned. …….. IUSF convener Wasantha Mudalige announced his intention to take over the parliament building.]If this is a fact then to my mind, the arrest of this Protestor was lawful.

6.

 [Bhavani Fonseka Human Rights lawyer:

(i)                  “And what happened in the early hours of the morning was extremely worrying with violence targeting peaceful protestors”

This is a deliberate falsehood. Is it her position that forcibly entering and occupying the office of the Head of State is considered a peaceful protest in law?]

(ii)               [“This is an indicator of what this government is going to do in terms of repression and the threat to basic rights and rule of law in Sri Lanka.”

Another lie was calculated to discredit the government of Sri Lanka. ]

7.    Centre for Policy Alternatives:

(i)                  [Addressing a letter to the Attorney General the CPA states as follows:“Based on media reports hundreds of military personnel and police blocked the access roads to Galle Face Green shortly after midnight on 21st July 2021 preventing the public from entering the area. Following this the military and police armed with riot gear attacked the protest site.”                                                             The protest site on Galle Face Green was not attacked. Video footage is available showing police calling out to protestors to move from the Presidential Secretariat to the Galle Face Green.]

(ii)               “Assaulting peaceful protestors”The forcible entry to and occupation of the office of a Head of State can never be deemed a peaceful protest in accordance with the universally accepted definition of what constitutes a peaceful protest.

(iii)            “Dismantling the tents.”The list of tents given by Aragalaya leaders were all in the area of the Bandaranaike statue and covered by the Court Order issued on 20th July. Refusal to obey the Court order resulted in the dismantling of the tents.

(iv)             “Video footage shows unarmed protestors being assaulted by the police.”    Video footage also shows heated confrontations with the Police by Protestors defying the Police leading to their evacuation. Any citizen taking part in a riot would be aware that the Police would use riot gear. There were no serious injuries and this is pure exaggeration to gain sympathy.]

Ultimately, Former President Gotabaya Rajapaksa who was brought to power by the People, is now a zero. If  Mr Gotabaya Rajapaksa realises that it was also his own use of war victory, which was extended to Politics that brought him down exponentially, through his own negative karma in the war against Tamils’ it would be a great heritage for the future generations at global level.

Closure is essential towards this. It is also a lesson for LTTE supporters who invoke the past in which LTTE also abandoned the laws of war. When we take benefits from that war, without taking ownership, we bring the war standards in civilian life also. Thus we invoke the lawlessness in that war, in our daily life.

Had it been limited to the LTTE, and the war against them only,  Mr Gotabaya Rajapaksa would not have taken oaths at Ruwanwelisaya which, like the Silk Road is a heritage. When heritages are disturbed for profit purposes, they bring with them the old liabilities at exponential value. Hence the collapse.

THE ONLY ME TAMIL

Significant number of Diaspora Tamils claim that the ethnic war, using weapons was due to Racial Discrimination. I also attributed Racial Discrimination as the reason for the pain I felt at the University of NSW. I fought on that basis in courts of law. They all dismissed me. My declaration began with the following letter:

906/56, Carr St

Coogee 2034

11 August 98

The Dean

Faculty of Medicine

University of New South Wales

Dear Bruce,

This morning, in consultation with my husband, I made up my mind to return to Sri Lanka as soon as possible – to a place where I can perform as a Professional in all my creativity.

I heard Pauline Hanson on the 4 Corners Programme last night. Ms Hanson suggests that we go back to our countries of origin if we cannot be like them. It hurts that we even have to hear such things. In the name of ‘Freedom of Speech’ we – the new Australians are being made to lose our freedom to live as individuals. If the leadership of Australia is unable to turn it around – to make up for their negligence in failing to hear the cries of new Australians – one has to wonder whether Ms Hanson is expressing what these leaders (and employers) feel themselves in their heart of hearts. This is the million dollar question to which I have been seeking a favourable answer – that the leaders of the country to which we brought our children and made them call it their ‘home’ would ensure that it is ‘home’ for our children. But, my experience during the past 13 years has failed to deliver the answer that I have been seeking so desperately. When an educational institution such as the University of New South Wales also demonstrated that it was no different – I do not wish to waste any more time – hoping.

I am sorry if this causes you any inconvenience, but I am quite happy to handover to your satisfaction – to a person of your choice. I am not arrogant to think that I am indispensable. There are so many excellent Accountants in the market (might even ease the unemployment problem) and I sincerely wish you the very best – for you are a good leader.

Yours sincerely,

Gaja Lakshmi Paramasivam

The letter was written during Nallur festival.  There was positive sharing from many parts of the Medical faculty. I did prolong my stay but the more natural I was, the higher the level that the conflict was escalated to. When we are true, that truth escalates the conflict to the appropriate level. Mine was heard by the then Chancellor – Sir Anthony Mason – a law expert. The Chancellor ordered an investigation. That investigation did not seek and find the truth.

The Sri Lankan parallel of this is the escalation of the ethnic problem to UN level. But that has also failed to seek and find the truth.

The parallel of my Court actions are the cases filed against various politicians in Sri Lanka and beyond. In my case, I first shared my pain through emails to all concerned within the UNSW. Later it extended to others concerned, including the queen. I did receive a response from Mr Tony Blair  who was then Prime Minister. It made me feel connected. Likewise, I did get response from the UN once and I felt included. Often, in public life, we tend to expect returns as per the official portfolio. But that is theoretical. Being included is the real franchise to participate. If our participation is not expressly opposed, then we have the moral obligation to know that our ‘protests’ have been accepted.

In my Australian battles, I realised that my investments led me to have insight into the minds of those whom I opposed. It is that ‘insight’, known as the third eye in Hindu philosophy, that helped me realise that my pain and loss were escalated to ‘intuitive intelligence’. This meant that it was of exponential value to me.

This morning’s mail brought me the regular acknowledgement from our Australian Minister for Foreign Affairs the Hon Penny Wong whose recent service in including Pacific Islands is deeply valuable to me. As per my mind that inclusiveness resulted in the outcome indicated by Sky News as follows:

[Anthony Albanese offers Australia's support to Pacific leaders to travel to London for the state funeral of Queen Elizabeth II]

This morning’s mail brought also the following response from Trevor Jayatilleke who is in my UN list:

‘The circuit breaker for Sri Lanka's Debt Cycle lies in the Jaffna Peninsula and nowhere else in  Sri Lanka., and that is the crux of the matter. God (Hindu or non Hindu) places the solution to a crisis in the right place. You are right and our Politicians are ignoramuses or too shy to admit it and living in a fool's paradise.

Thanks Lakshmi.

Sincerely,

Trevor

16/9/22.’

To me, Trevor is a Common Sri Lankan and hence belongs in the UN list. But the solution is not as simple as Economic wellbeing.

Certainly not so, in the case of  one who laments that Tamils are not allowed to mourn in Sri Lanka.

I responded as follows to his group:

One does not need another’s permission to love. Hence, one does not need permission to mourn the death of such a person. This is clearly provided for in the Sri Lankan constitution, as a fundamental right. Article 14 (1)(e) provides as follows:

[Every citizen is entitled to –the freedom, either by himself or in association with others, and either in public or in private, to manifest his religion or belief in worship, observance, practice and teaching;]

It is highly likely that Sri Lankan police would arrest someone who is publicly mourning the LTTE or JVP. The reason is that they are respectful of their own who died fighting against armed rebels. To oppose rebels mourning publicly  is an endowment of such  a natural law.

If you are referring to war memorial in Jaffna University Premises being demolished, that alleged memorial was a disturbance to Education. Armed power is the Opposition of Intellectual power.  The memorial ought to have been in an area that was ‘home’ to the group. In the case of  civilians it was their family cemetery or places of ancestral worship in their own religious forms. To the LTTE it was the jungle areas of North.

Gaja]

Truth will lead us to the ultimate solution.

THE ANCESTRAL PROTESTOR

[I voted for Gotabaya Rajapaksa like millions of other people. I went to the protests to make up for the wrong decision I made," Wimukthi said.] Sri Lanka's protest movement toppled a president. Then came the crackdown by ABC Australia

Can the outcome of a lawful voting process be reversed by mere protests? The answer as per my mind is ‘NO’. The reversing force needs to be equal or stronger in strength. This requires the Protests to be continuous and uninterrupted over a period longer than the period for which a government is elected through lawful process. This is the way of Prescriptive Rights which are Natural Rights of Belief.

When elections were held through lawful process, the outcome has the blessings of those from whom we inherited the laws and processes that regulate democratic elections. To effectively oppose that outcome, the causal forces of the Protests have to be stronger than the forces that produced the Election outcomes. Hence the longer uninterrupted period.

This morning, I shared as follows in this regard:

‘As shared through most of my articles – expressly or in spirit, belief renders us the natural entitlement to represent. This is the basis of our franchise to participate in Public affairs. In Sri Lanka and Australia, it begins at 18, with voting right to elect a government. Some of us extend it to other forms – including protesting through our writings – as I often do, Peaceful Assembly etc.’

Those who voted for Mr Gotabaya Rajapaksa, confirmed his leadership in defeating Tamil Armed Rebels in 2009. They effectively endorsed his leadership in this regard.  Tamils were left to themselves to mourn the pain and loss that the community suffered. Ten years later, the LTTE resurrected itself as Easter Bombers in April 2019. This was confirmed by the Commonness in their pathways.

The UNP candidate in the 2019 Presidential Elections, was NOT Mr Ranil Wickremesinghe but Mr Sajith Premadasa. The Samagi Jana Balawegaya - United People's Power,  was formed as a breakaway party by Mr Sajith Premadasa, in 2020. This in turn made Mr Wickremesinghe the parallel of the Queen. That is how the forces of truth have worked.

The protestors who Opposed military rule contributed to this outcome. Not so those who endorsed unregulated de facto military action against rebels. Protests take many forms. Belief based protests in the mind of a true owner is the Power of One. It spreads Itself exponentially. It invokes also the ancestral powers of  Legitimate Opposition in Parliament.

When the power of belief of current protestors is weaker than the power of those who are committed to lawful processes – one is able to successfully invoke ancestral powers, against Protestors also. Hence memorials to strengthen ancestral powers. Ms Kumaratunga invoked this power in 2015 Presidential elections through which Mr Mahinda Rajapaksa was defeated. True powers of previous rule become ancestral powers that work exponentially when their heirs are in need. Hence in Hinduism, one settles Pithur kadan/Ancestral Debt through ceremonies at particular places like Keerimalai in Northern Sri Lanka.

Mr Sirisena through whom that power worked in 2015, made it negative in 2018, when he replaced Mr Wickremesinghe with Mr Mahinda Rajapaksa as PM.  There were no People’s  protests against this.

Truth ultimately delivers as per our belief. As per my belief, it was the Crown / Ancestral Power of Sri Lanka that toppled the President and the Protestor group became Its  medium.

PRINCE OR REBEL

The best return for me, in sharing my truth is the identification with others’ truth in a free forum. Yesterday, I shared my truth under the title ‘THE QUEEN IS OUR COMMON ANCESTRAL SPIRIT’

This attracted response from a Tamil Diaspora Professional as follows:

[Ranil Uncle, being a "neck tie collar, pocket no dollar man", has to worship the queen followed by the King. In fact he is flying to attend the funeral. Uncle Ranil and King Charles are in the same boat, same age, waited for so long, only got the chairs by sheer chance and never elected by the people and who work for their own wellbeing]

My response was:

[They were never elected because they are both Monarchs. Under the hierarchical system, young ones have to ‘wait’ for their turn. In Ranil’s case, he demonstrated this tendency to ‘wait’ for the Court decision, during the Constitutional crisis. Our courts continue to use English law and hence it makes sense that Ranil would ‘wait’ like a prince, instead of demanding like a rebel. Likewise, Charles.

Ranil goes to pay his respects to the queen who represents that system. This would mean also, that he will be the parallel of Charles – i.e. Governor without Executive powers. The rest will happen when others recognise that British ancestry  in us.]

In the article ‘Sri Lanka’s Left Turn’ at foreignpolicy.com ,  Journalist Devana Senanayake highlights as follows:

[The mass protests in Sri Lanka that led to the removal of President Gotabaya Rajapaksa and the appointment of a new president, Ranil Wickremesinghe, in July have now stalled. As Wickremesinghe cracks down on dissent, and demonstrators figure out where to go from here, many critics and experts have overlooked the role the country’s left has played in the protest movement.]

I am NOT one of those who overlooked this aspect. I learnt by the truth in the mind of  a pro-Rajapaksa member of a ‘family’ group, that JVP was involved. To the extent my sharing was true, I identified with the truth shared by others in the group.  I developed this through religious elders according to whom ‘when we know ourselves, we identify with others’ truth. Recently, I learned from a family junior, the phrase ‘emotional intelligence.’ I then worked out that it was the same as the wisdom shared by my religious elders.

Most of us, learn from family through the hierarchical pathway. Mr Ranil Wickremesinghe’s family elder in politics is Mr J R Jayawardene. A Tamil elder stated as follows about this:

[Ranil Wickremasinghe is the political son and heir of JR , who is an Anglophile.  So it is not surprising! He might attend Charles’ coronation too .]

What would a monarch do when there is an uprising against her/him? Suppress the uprisers. Hence the use of PTA – Prevention of Terrorism Act – confirming that he was protecting the Monarchy / Executive Presidency inherited from the Rajapaksa brothers.

When Mr Gotabaya Rajapaksa was elected as President, it was due to suppressing Tamil leftists – who were labelled Terrorists . That group of voters rejected Mr Ranil Wickremesinghe. But truth prevailed and he became the heir of King Rajapaksa, and got even with the folks who elected a monarch (Gotabaya Rajapaksa) through a Democratic process. It’s as simple as that! A lesson for all Sri Lankan protestors who abuse the process of Democracy, which,  to be successful, requires us to vote for those we believe in and not those who promise economic prosperity out of borrowed money which has become sin.
