Constitution and the Bible

Highly respected Sri Lankan lawyer Ms Kishali Pinto-Jayawardena asks the question ‘what need is there of a Constitution for Sri Lanka?’ Sri Lankan Constitution’s parallel in my religion – Hinduism - is the Bagavath Geetha. During one of my Australian Court cases – I said to the Magistrate that since they did not have a Hindu scripture – I will take oath on the Bible. Magistrate Smith said words to the effect ‘We must have one’. But the officers could not produce one. Hence I took my oath as usual on the Christian Bible. This practice of the People taking oaths on their sacred books surfaced during a hearing in Colombo court. I then learnt from our lawyer friend Manoharan that Buddhists did not swear but affirmed. I wondered whether it was because they did not have a book of Buddha Sasana. The Fourth schedule in the Constitution of Sri Lanka, provides as follows:

[FOURTH SCHEDULE ARTICLE 32, 53, 61, 107, 165

"I……………………………………………………………… do solemnly declare and affirm/ swear that  I will faithfully perform the duties and discharge the functions of the office of ………………………………………………… in accordance with the Constitution of the Democratic Socialist Republic of Sri Lanka and the law, and that I will be faithful to the Republic of Sri Lanka and that I will to the best of my ability uphold and defend the Constitution of the Democratic Socialist Republic of Sri Lanka.”]

I would take oath on the Bagavath Geetha. But I do not have knowledge of most of its verses. In his paper ‘THE LAW OF TESTIMONIAL OATHS AND AFFIRMATIONS’ Mark Weinberg- Senior Lecturer in Law, University of Melbourne, quotes as follows:

"Uncle Rastus, testifying in a certain law suit, refused to be sworn. 'Ah will affirm', he said. 'But Uncle Rastus', said the judge, 'how is this? Last week, in the Calhoun case, you swore readily enough'. 'Yo' honah', said Uncle Rastus solemnly, 'Ah was mo' suah of mah facts in dat case den Ah is in dis one'."

To my mind when one believes that her/his statement is true and one believes in the religion and therefore its officially accepted scripture, one would swear. If one merely confirms observation – of what happened – it is affirmation. If therefore the President of Sri Lanka affirmed then is he bound by the constitution – as interpreted by law experts who have certain level of belief in law as given form by their elders / seniors ?

Ms Kishali Pinto-Jayawardena states:

[This query becomes pertinent in regard to the recent appointment of an Ombudsman, a retired Deputy Inspector General (DIG) to boot, tasked with inquiring into public grievances and complaints. That appointment was made despite a constitutional office of the Parliamentary Commissioner for Administration (Ombudsman) being functional for decades, albeit historically critiqued in respect of the limitations of that office.

This is even more an insidious undermining of the constitutional process than the appointment of military-led Task Forces to take over manifold civil and policing functions, ranging from building a lawful, disciplined and virtuous nation to protection of archeological sites in the East. We would expect more Task Forces, stuffed with military and police appointees to be on the horizon with all the deadly inevitability of an incoming tidal wave. But even so, to duplicate constitutional institutions is quite another manifestation of the steady creation of an omnipotent centralisation of power in the Presidential Secretariat which has gone largely unremarked.]

If as per his own assessment of his skills – the current president needs a team of military officials to uphold and defend the constitution as interpreted in good faith by Mr Gotabaya Rajapaksa, would that be in breach of the Constitution? Members of the Judiciary themselves would have diverse interpretations of the same law. To my mind, the Doctrine of Separation of Powers between the Judiciary and the Executive is confirmation of this diversity and Equal right to interpret. Where there is diversity in form – there needs to be separation and Equal status – so one does not become junior of the other.

The question here is whether the President to the extent he believed that the People  have a need had the duty to develop a structure as per that need or whether he had the duty to act as per the letter of the Constitution – a constitution written by someone else whom he does not consider to be his senior. Former is exponential and spreads itself – like the Coronavirus whilst the latter is relative because it is alien due to lack of belief which has been demonstrated repeatedly by this president. If the Rajapaksas were driven first by law – they would have not defeated the LTTE. Given that majority Sinhalese refer to the LTTE as ‘Terrorists’ and majority Tamils refer to the LTTE as ‘freedom fighters’ confirms that our investment in common law is weak. Many law experts of Sinhala origin refer to the LTTE as Terrorists. I am yet to hear one Tamil lawyer refer to them as Terrorists. This is because we are one community. This means we discipline to become one. Those driven by belief in law more than belief in community – including the lawless parts – lack jurisdiction beyond their local law circles.

I reported our Bank to the Ombudsman here. I knew that the other side was lawless but since my official community position was lowered after my painful experience at the University of NSW, and after the Judiciary kept dismissing my complaints – I did not consider it my duty to do due diligence checks in the case of donors. I became like the current Lankan government in the case of China which as a different government structure to Sri Lanka and is therefore not a relative by structure. The Ombudsman as usual dismissed my complaint but recently I knew that my contribution had worked when Westpac was accused allegedly of 23 million breaches of money laundering and counter-terrorism finance laws. News.com.au reported further as follows:

[The crisis claimed the scalp of Westpac chief executive Brian Hartzer as well as chairman Limdsay Maxsted, who will now bring forward his retirement to the first half of next year.

The scandal deepened further when comments allegedly made by chief executive Brian Hartzer to senior staff were leaked to The Australian, including claims the scandal “was not playing out as a high street issue” and that the Westpac board “don’t need to overcook this” because “for people in mainstream Australia going about their daily lives, this is not a major issue”.]

This also the case with Sri Lankans voters – majority of whom have no relationship with the Ombudsman nor the Judiciary in day to day life.

The lockdowns and social distancing rules by the government during the virus threat were followed by majority Australians not because they knew the science of it but because the government sweetened it with the economic compensation to do so. Again, Australia by its structure is related to rich nations. This includes religion. Sri Lanka’s isolation from those nations was confirmed as follows at UN level:

[In a hard-hitting message, Sri Lanka this week abstained from voting for any candidate–Canada, Ireland or Norway–from the Western European and Other States Group (WEOG) in a contest for the UN Security Council’s (UNSC) non-permanent seats.]Sunday Times

Since this government used the status of these Western countries – especially the USA to eliminate the LTTE but failed to show gratitude that ‘donation’ became a debt. This fundamental value, to my mind,  is built into the Kandyan Law – through Section 4 of the Kandyan Law Amendment & Declaration Ordinance:

[4(1) Subject to the provisions and exceptions hereinafter contained, a donor may, during his lifetime and without the consent of the donee or of any other person, cancel or revoke in whole or in pan any gift ……..]

The above provision prevents donations from becoming debts due to ingratitude on the part of  the donee. Hence as per the spirit of the above law – those nations that shared their status with Sri Lanka ‘withdrew’ that status when the Government demonstrated lack of respect for them as seniors. Given that Sri Lanka was a junior to America in this regard, if Sri Lanka had honoured that true positioning the junior would have had the right to share in the higher status of the seniors. When one takes equal position – without settling that debt – it naturally demotes one’s institution structure and therefore status relative to others. Hence now Sri Lanka has become China’s donee.  

The written law helps us to connect with each other through a common structure. Developing the common structure requires ‘savings’ from current benefits. By respecting those before us who ‘saved’ we inherit those structures. Now that the government of Sri Lanka is promising to repeal the 19^th Amendment by those who are heirs of the global system of justice – one must expect further loss of status in the minds of those who are supporters of this government that has very little structure beyond its military circle. Our genuine contribution at the higher level would help us mind-merge with higher thinkers and also our ancestors who gave us our customary laws. When we take positions as per those laws – the villagers will mind-merge with us directly and thus isolate the military government.

Sri Lanka confirms Trading in UN Membership

Those who make a structure and/or maintain it work the structure. We pay our respects to our elders because they are part of our inheritance. We attribute to Guru for that reason. Otherwise we would tend to think that possession is ownership. One of the experiences that confirmed the above to me happened here in Australia – at the University of NSW(UNSW). I was part of the team recruited to restructure the Accounting system to be more democratic. As usual I had conflict with my seniors who were from the ‘old system’. The executive director of the Medical faculty – Jeff Warnock said to me at one stage that he had contacted my previous supervisor Ms Colleen Moore because he was not sure who was right – my seniors or myself. I asked Jeff ‘What did Colleen say?’ Jeff smiled and said that Colleen had said that she thought that when I left the system I had developed would ‘collapse’ but that it was still going. I thanked Colleen in my heart for attributing credit to me. I resigned from my substantive position within the UNSW and was recruited by Sports Medicine which was an independent business unit. I continued to constructively criticize the Central Administration and this resulted in my departure from Sports Medicine also. It was during the funeral of the Director of Sports Medicine – Dr David Garlick that I learnt about the ‘collapse’ within the Medical Faculty. Sydney Morning Herald reported it as follows:

[The fight erupted at the University of NSW in 2001 when Professor Hall was accused of scientific misconduct, including misrepresentation of scientific data, fabrication of experimental results and misuse of research grants.

Several inquiries, a reference to the Independent Commission Against Corruption and the resignation of the vice-chancellor, Professor Rory Hume, followed.]

One of the main areas of controversy raised by me was management of National Health and Medical Research Council (NHMRC) grants. Details of this are in my book Naan Australian. Had the Research office heard me and included me – the University would have been ‘saved’ the bigger pain. If one takes my contribution as genuine Energy then that would have spread to research area also – as protective force. Colleen knew this intuitively about my work and thus that system did not collapse. I was reminded of this this morning when I read the subject heading ‘WHO IS LISTENING & WHO CARES ?’ – about the UN Security Council Vote to elect Non-Permanent members. My immediate response from within was ‘I am listening / reading and I care’

As per my experience – when we genuinely care and complete the cycle of truth through our local experience that completed Energy becomes a permanent force at the highest level of influence. I wrote a paper about my UNSW experience using Racial Discrimination law as the measure and submitted it to the UN. All I had to do was to ensure that what I wrote was true and intellectually logical to me. I do not know how the UN received it or what it did with it. But the result is my elevated thought structure that returns reliable satisfaction to me. This has helped me balance the effects of Caste Discrimination in Northern Sri Lanka, which was diluting the power of Vaddukoddai Resolution 1976. One who is carrying unjust discrimination on one basis does not have the moral authority to declare independence on the basis of belief. Even though I did not give birth to that resolution – I am a strong component of the Energy that works that Resolution. Likewise, in the case of UN. Like in Postal Acceptance rule in Contract Law, once we perform to confirm ownership / completion – on the basis of belief – the other side is automatically taken as being accepted. Prescriptive rights are accepted in law for that reason of Belief. That is also the power of democracy.

The government may nor hear us but when we contribute through belief – the sovereignty of our contribution is completed. In contrast  - the Sri Lankan Government confirms Trading in  through its UN Membership – as it did with  membership in Lankan Parliament:

[In a hard-hitting message, Sri Lanka this week abstained from voting for any candidate–Canada, Ireland or Norway–from the Western European and Other States Group (WEOG) in a contest for the UN Security Council’s (UNSC) non-permanent seats.

The basis for the decision was conveyed to all three countries. They were made to understand that “they also need to rethink the way they do business with us,” an authoritative source said.

“It was an important way to make our vote count,” he asserted. “There is a need for recalibration of our relationships, and a serious re-evaluation of how all three countries deal with us in the international arena.”]

[Sri Lanka voted for India and Kenya in the Asia Pacific and Africa Group respectively]

One is entitled to conclude that the vote for India is NOT on the basis of belief but for quid pro quos. These are reasons why the UN structure has lost power as WHO confirmed during the pandemic.

Confirmed - Won the Battle & lost the war

 

Unsettled problems become passive and do not go away. Some seek to forget them but to the extent victims continue to hurt, the problem remains. This is referred to as Karma in my circle. It confirms the perfection of truth. The more conscious we are of truth – the less likely we are to suffer mental instability.

The Rajapaksa government boasted and continues to boast that they won the war against Tamil Tigers. Given that the Tamil Tigers were a part of Tamil community and the Politicians who represented the community opposed the government and declared political independence through the Vaddukoddai Resolution in 1976 – the war was political. The fight between the Armed forces   and the LTTE was just the battle. The People who elected the leader of the Armed forces as the President thus demoted the government to military level. The real war has now escalated itself through the victims to global  war and regional battle between India and China.

As per my knowledge, the then government ‘bribed’ the Eastern leader of the LTTE – Karuna Amman/ Vinayagamoorthy Muralitharan. The knowledge of Karuna as an insider was a key to defeating the LTTE. Was Karuna right or wrong? What is the measure?

I met Karuna in 2003 through a UNDP project. Before going to meet him, we were led to Vaharai area and there a leading member of the LTTE shared with us the insight that Karuna had in terms of  the battle against the Government forces. As per that sharing, Karuna had sensed that they were going to get bombed and had immediately ordered that they vacate the area. True to his declaration the place was bombed within minutes after their departure. Many pro LTTE Tamils refer to Karuna as ‘Throgi’/Traitor. If the same measure were used on Northern LTTE – which killed Tamil politicians – then yes Karuna deserved it. One must believe not only in what happened but also in the measure used to mark one right and the other wrong.

As per my discovery that is the way  the system of Truth works to support or not support us. Believers are supported even though the official law may say that they are wrong. That is the way of Sovereignty. In 2008, the folks of Mankerni whom I served during post-tsunami period urged me to go to their place. For some reason trains were cancelled and I decided to take the bus. At the main Bus stand in Pettah – checking was heavy and I felt that I was being checked more rigorously than others. I put it down to me being recognized as a Tamil. I accept such extra measures as necessary for the officers to do their duty. It was later that I learnt that that morning, Major General Janaka Perera was killed in a bomb blast at Anuradhapura. My experience on that day are at http://www.austms.org/news_and_events/Batti.pdf

The following confirms that I was suspected of being an associate of Karuna from Kiran:

[I later asked him ‘how come?’. He said he was an army officer returning after his leave. He did casually ask me as to why I would not stay at ‘Kiraan’ (on the way) and I said because I did not know anyone there. Later I felt that he was testing me in a nice way. He got off at Oddumaavaddi – and I said to the conductor to stop at Sivathondan Nilayam Chiththandi. I do not know why I said Chiththandi instead of Chenkaladdi. I said it many times to the conductor as well as the passenger next to me. The bus stopped and the conductor said ‘there you go sister’]

These experiences confirm to me that officers in the armed forces were not ruthless when they are not under direct pressure to act in a certain way. Kiran is Karuna’s area and hence the questioning. But my word was taken as true. Had I gone to  Chenkaladdi at that time – the gates would have been locked and I would have had to jump over the gate in which case I may have been the target of the armed officers. At the Chiththandi girls’ home – the gate is close to the home and they could hear me knocking and explaining who I was. That was ‘intuition’ leading me.

Today when I read the Daily mirror report ‘I killed some 2000 to 3000 soldiers in one night –Karuna’ – I smiled. As per that report Karuna claimed as follows:

[Chairman of the Karthivu local government body has said that I am more dangerous than the coronavirus. That is true. When I was a member of the LTTE, I killed some 2000 to 3000 Sri Lankan army personnel in one night at Elephant Pass. I have killed more in Killinochchi. That is certainly higher than the number of lives the coronavirus has claimed in Sri Lanka,” he said addressing a gathering in Navadinveli, Ampara yesterday.

He said that Prime Minister Mahinda Rajapaksa has extended him an invitation to join the parliament from the National List. However he added that the invitation was declined as he would be elected to parliament with the people’s mandate.]

To Karuna his pathway is the law that binds him. The current government also accepted that level. Until therefore all LTTE members are released from custody – this government would carry negative Energy in terms of war. This was indicated by the high level infection of Corona virus within the Sri Lankan Navy. If indeed there is war between China and India – it is highly likely that the likes of Karuna would be recruited by India – especially now that he is free of the direct influence of the Rajapaksa government. This confirms again that the war is yet to be won. It’s not easy to win against natural forces of Belief that unite beyond local borders. If India dominates – then the war is taken to be won by Tamils.

Power of Article 91

 

Does an article in the Constitution have self-governance power? To my mind, the answer is ‘yes’ when  its origin was based on belief and a self-governing person invokes its powers. Article 91 about which I have been writing in relation to the SJB – was activated by me including as follows:

[The fundamental rights case before the Judiciary is about elections. But there was already an issue with the SJB candidates being in two parties when submitting their nominations. Article 91(1) (b)(ii) of the Sri Lankan Constitution – under chapter headed ‘THE FRANCHISE AND ELECTIONS’  - states:

[91. (1) No person shall be qualified to be elected as a Member of Parliament or to sit and vote in Parliament –

 (b) (ii) if he - stands nominated as a candidate for election by more than one recognized political party or independent group in respect of any electoral district, ]

The fundamental principle here is that one cannot be in two political parties at the same time. This article was breached by Mr Premadasa and others being in Samagi Jana Balavegaya (SJB) and the UNP at the same time. In his Island article ‘Gota-Sajith alliance: Exercise in futility?’ Dr Upul Wijeyawardhana states:

 

[The August election is important for the UNP and the SJB, solely for these reasons of their own disputes. But what about the country? The country needs dynamism and for that some of the idiotic aspects of the 19th Amendment need urgent change. We need to empower the President. After all, he is not a figurehead as he is directly elected by the voters and is responsible to them. In fact, he is the only person who commands a direct pubic mandate as all parliamentarians are not elected on the basis of a constituency. To have proper representation, we need to revert to a constituency-based parliament. Provincial councils have proved to be a complete waste of money and Yahapalanaya, paradoxically, proved their redundancy by not holding elections! Many independent commissions have proved to be anything but independent and a complete rethink is badly needed.

Sri Lanka has the best of brains and it is high time ways and means are devised to use them to make Sri Lanka great again!]

Lanka’s king Ravana also was clever. He was so clever he had his own plane. But his problem was that he did not share his intellectual powers to connect to wider world. The expressions ‘We need to empower the President. After all, he is not a figurehead as he is directly elected by the voters and is responsible to them.’ confirm similar block. One who believes is naturally empowered exponentially. Such power spreads like the covid19 virus. Such a leader does not need intellectual powers. In fact anything more is likely to weaken the power of belief.

We can complete the connection between ‘Cause and Effect’ through belief and / or through intellectual logic. When the current president promised to withdraw from the commitment to the UN he confirmed his reliance on local belief. The Sinhala Buddhist community voted him into power. In his paper ‘Tamil Buddhism in Sri Lanka’, Professor Gintota P V Somaratna states :

[In the analysis of the historiography of Buddhism in Jaffna, several questions surface in determining historical facts. In our study, we have to be aware of who writes history, with what agenda in mind. One has to observe whether the historian’s own standpoint, impacted by national and ideological affiliation, contributes to an agenda. When religion is used as an instrument for politics, the politicisation of religion would result.  The historian may be playing, unintentionally or consciously, into such a scheme. There is a danger of the past being abused for someone’s own purposes.  This is very clear in the interpretation of historical material as we see clearly the differences and conflicts between the Tamil and the Sinhalese perceptions of history of Sri Lanka.]

Those who wrote the 19^th Amendment to the Constitution demonstrated belief in wider world. Their belief has been written as laws that others could use to complete the picture of ‘Cause and Effect’. It is equal to the structure of the current regime. If it is made junior to the current Regime’s form of belief – many intellectuals will not be able to complete the picture and this would lead to mental instability and effective wastage of investment in higher education. When no politician has taken action in relation to the breach of Article 91 it confirms the serious deterioration of intellectual powers of the Parliament.

But then any believer can invoke the mind of the architect of that article to complete the picture for her/himself. In turn that completed knowledge would spread exponentially including through the media, to become a reality – the Ultimate Reality of Belief. Hence the truth of divisions within UNP which can make it more powerful as an opposition – especially if it mind-merged with Tamils genuinely seeking a common solution.

Buddhism foremost article in the Constitution, is confirmation of Politicising Buddhism. Its presence automatically demotes the status of the Constitution to relative power. That was how Tamils became Equal Opposition in National Parliament when they completed their circle of belief. This will continue to happen from time to time when Buddhism is used for personal benefits and/or Minorities invoke the absolute power of their belief.

India Jaffna China

 

I thought about the philosophy of karma in relation to significant experiences in my life. I reconfirmed to myself that the ‘unknown’ intervention was due to my past karma which in my case has been net positive. Through the lives of others known to me I am able to identify that when we become passive in current life, our past takes-over. A good example is our family’s investment in our temple in Sangrathai-Thunaivi – which is part of the District of Vaddukoddai where the first political declaration of Self-Governance was made in 1976. As per the Island report headed TNA puts forth two sets of proposals for N&E; ITAK Leader initiates talks in Waddukoddai, Jaffna’ :

[Talks commenced at Waddukoddai, Jaffna, on Saturday (13), with the participation of ten former TNA MPs. ITAK leader Mavai Senathiraja chaired the meeting. Among those who participated at the discussions were TNA spokesperson Sumanthiran and PLOTE leader Dharmalingham Siddarthan]

Today is St Anthony’s feast. I dedicate this article to St Anthony who has always answered my prayers.

We tend to interpret what happens at three levels – through the physical, intellectual logic and through belief. We refer to each layer as Mandalam. This was used as follows by the Chola dynasty in South India:

[A mandalam (maṇḍalam meaning circle; also known as pāḍi) was the largest territorial division in the Chola state. At its height, the state was divided into nine mandalams which included areas in Sri Lanka and other conquered areas. The two core mandalams were Chola-mandalam and Jayangondachola-mandalam……

When Raja Raja Chola I annexed the northern part of Sri Lanka, he named the area Mummudicholamandalam which was also known as Ilamandalam or Izhamandalam. Anuradhapura and Polonnaruwa were the major settlements in the region.] Wikipedia

These are lateral Administrative divisions. When one believes at the root level as per today’s structure – the heritage leads that person. That is how the above passage came to me when I sought to respond to ‘1st meeting of China-Sri Lanka Belt and Road Political Parties Joint Consultation Mechanism held’ article by ‘Ending Poverty in China’ news medium.]

It is significant that Polannaruwa is included as part of the Tamil dynasty of Lanka known as Eela Mandalam. Polannaruwa is the homeland of immediate past President of Lanka during whose presidency Muslim extremists bombed common areas. One who fights for homeland would fight to defend and not attack.

To the extent India facilitated armed rebellion to protect Tamil Homeland,  its past positive investment in Lanka would have been activated to Energise those who benefited from that rule. This includes those to whom Polannaruwa and Anuradhapura are homelands. By taking his oaths at  Ruwanweliseya,  Anuradhapura, the current president invoked the Tamil Homeland power. This was facilitated by those who believe/d in the whole of Sri Lanka as per its current borders.  Since Mr Rajapaksa relied on past and therefore promised to withdraw from the commitment to current global values through the UN, the borders were redrawn as per his oath in the sacred city. Tamils and Muslims to whom their current areas are homelands – empowered this separation.

As per current news reports the question being asked is as to on whose side Sri Lanka will be if there was war between China and India. A genuine study of the forces that gave birth to the current division is needed to project the consequences of  an alliance.

As per my belief, China’s current alienation began with it activating its past for current economic purposes. Hence the Silk Road which is listed as ‘world heritage site’ invoked the global pandemic. When it is belief based the believer’s form is the right form. Someone else may give it another reason but so long as that is also belief based – that would be right for that environment.

If Silk Road is right for the ‘heritage’ environment – then when given for in the current environment – it would invoke its partners including in opposition now. As per UNESCO report about the heritage:

[The series of Buddhist pagodas and large, elaborate cave temples extending from Kucha (now Kuqa County) in the west to Luoyong in the east, record the eastward transmission of Buddhism from India via Karakorum, and demonstrate an evolution in the design of stupas as local ideas were absorbed.

Karakorum : The Karakoram is a mountain range spanning the borders of India, Pakistan and China with the northwest extremity of the range extending to Afghanistan and Tajikistan.  It begins in the Wakhan Corridor (Afghanistan) in the west and encompasses the majority of Gilgit-Baltistan (Pakistan) and extends into Ladakh (India) and the disputed Aksai Chin region controlled by China.]

To my mind, it is no coincidence that the Pandemic problem has extended to Ladakh based border problem between India and China.

Since Buddha was born in India Lanka has the duty to respect India as the senior in this relationship and China as an equal junior. If India is respected as the senior – then the heritage power would support Lanka through global partnerships. If due to the money from China, Lanka becomes China’s junior – India will be assisted by Tamils to mentally redraw the borders through areas of influence – offered and accepted. The ancient powers towards this purpose would weaken Lankan Buddhist minds to become juniors of Indian Buddhist minds.

Heritages are Sovereign powers. Hence here in Australia, we pay our respects to the original owners of the land and this I believe protected us from major harm through the pandemic as well as racial conflict. Likewise Northern Sri Lanka which by belief is closely linked to South India than to China. Every Sovereign Unit confirms heritage to its owner.

As per Defence Lanka news report headed ‘Defence Secretary visits Jaffna to review security situation’:

[Defence Secretary Maj. Gen. (Retd) Kamal Gunaratne has visited Jaffna to review the security situation and the military’s support to mitigate the spread of coronavirus outbreak in the North, today.

The high-level defence delegation, including acting Chief of Defence Staff and Army Commander Lt. Gen.  Shavendra Silva, who is the Head of the National Centre for Prevention of COVID-19 Outbreak, Sri Lanka Navy Commander Vice Admiral Piyal De Silva, Sri Lanka Air Force Commander Air Marshal Sumangala Dias, acting Inspector General of Police, C. D. Wickramaratne, Security Forces Commanders of Jaffna, Mullaittivu and Kilinochchi, Division Commanders, Senior Deputy Inspector General of Police for North, Deputy Inspector General of Police for North and a few more officials, accompanied the Defence Secretary in his visit to Jaffna.]

Was that the purpose or was it to ‘show’ China that Jaffna was under their control? Article 3 of the Sri Lankan Constitution states:

[In the Republic of Sri Lanka sovereignty is in the People and is inalienable. Sovereignty includes the powers of government, fundamental rights and the franchise.]

As per the Franchise exercised by the People of Northern Province – the above group whose leader is Mr Gothabaya Rajapaksa – has no access to the Sovereign powers of the People of Northern Province as demonstrated by the exercise of the Universal Franchise. The powers of the current government are limited to security issues and during this covid19 period Jaffna did not rank high in the need for security – relative to other areas where the curfew was disregarded by civilians. The only reason that would require such a visit seems to be fear of India and its natural influence over Tamil Politicians who gathered in the Tamil Political Capital of Vaddukoddai.

Intuition About Lankan Navy

 

One who feels ownership identifies with early indicators. When the Lankan Navy was confirmed to have been infected, I felt that this was significant and I wrote repeatedly about it. Mine was belief based intuition. I recognized those who did identify with it – also as believers in me and/or in Sri Lanka. The following headlines by Economy Next, confirm that Navy had high level of infections:

Almost simultaneously, the following has been published by UK’s Daily Express:

[China's 'naval base grab' in Sri Lanka exposed amid WW3 India row

Due to Sri Lanka's inability to service the debt on the Mattala Rajapaksa airport, it was leased to the Chinese state-owned China Merchants Port Holdings Company Limited on a 99-year lease in 2017.

This caused concern in the US, Japan and India that the port might be used as a Chinese naval base to contain China's geopolitical rivals.

The row is reminiscent of ongoing disputes in the South China Sea as countries try to thwart Beijing's growing military presence in the contested region.]

Evidence of Remorse is used to reduce the level of punishment through the Judicial system. When we cure ourselves by feeling the victims’ pain as ours we are free of guilt. This is sometimes the only way to redeem ourselves from our sins. A wrong becomes a sin when there are structural changes.

Someone wrote as follows in response to  my recent article headed ‘Chinese Influence in Lankan Politics which concludes with the message -  ‘As a Tamil he needs to know that money divides and belief unites.’ :

[In 1984, there were many Tamil militant organizations and with great effort and time they were all made to unite together to form "ENLF" Their unity was brief.  The LTTE got a huge sum of 4 crores from one of the politicians of Tamil Nadu . The LTTE kept three fourths and gave one crore to one of their close outfits. That divided the militants and it never came together again.  Had the ENLF continued, Tamil History in Sri Lanka would have been different.  These are facts, as you say they are facts because  the truth is the nucleus.]

Wikipedia confirms the essence of this as follows:

[In April 1984 M. Karunanidhi invited the leaders of the five leading Tamil militant groups, Eelam People's Revolutionary Liberation Front (EPRLF), Eelam Revolutionary Organisation of Students (EROS), Liberation Tigers of Tamil Eelam (LTTE), People's Liberation Organisation of Tamil Eelam (PLOTE) and Tamil Eelam Liberation Organization (TELO), for talks aimed at uniting the groups. K. Pathmanabha (EPRLF), V. Balakumaran (EROS) and Sri Sabaratnam (TELO) accepted the invitation but Velupillai Prabhakaran (LTTE) and Uma Maheswaran (PLOTE) did not.

Shortly afterward EPRLF, EROS and TELO formed the Eelam National Liberation Front.^[2] The inaugural meeting of the ENLF was held at the EPRLF's office in Madras (now Chennai) and Ramesh of the EPRLF was elected the secretary. After the meeting Pathmanabha, Balakumaran and Sri Sabaratnam issued a statement announcing the formation of the ENLF:

Realizing that unity among the liberation movements is essential to take forward the freedom struggle of the people of Tamil Eelam, the leaders of the Eelam Progressive Revolutionary Liberation Front, Tamil Eelam Liberation Organization and Eelam Revolutionary Organization have decided to form a united front and name it Eelam National Liberation Front.

LTTE joins ENLF

In early 1985 Prabhakaran changed his mind about the ENLF and decided to join. On 10 April 1985 senior members of the ENLF and LTTE met at the Hotel Presidency, Madras. Those attending the meeting were: LTTE – Prabhakaran, Rajanayagam and Anton Balasingham; EPRLF – Pathmanabha, Kulasegaran and Ramesh; EROS – Balakumaran and Muhilan; TELO – Sri Sabaratnam and Mathi. After the meeting a statement was issued:

The Eelam National Liberation Front and the Liberation Tigers of Tamil Eelam have decided to work together to take forward the freedom struggle of the Tamil-speaking people of Eelam...The emergence of unity among these four freedom movements that have adopted the path of armed revolution is a significant event in the history of the freedom struggle of the Tamil people. This unity, a turning point in the freedom struggle of the Tamil people of Eelam, has helped the consolidation of the revolutionary forces and coordinates and strengthens the armed struggle. We expect the news about the unity among the armed movements would gladden and enthuse the people who are enduring army atrocities and hardships and intensify their determination and resolve to march on the path of freedom.

The unity amongst the Tamil militant groups was widely welcomed by supporters of the Tamil independence movement.]

To the extent Indians and Lankan Tamils believe in Sovereignty through their culture there is automatic unity. Likewise, between Chinese Buddhists and Lankan Buddhists. This unity is seriously threatened when money is given and taken without a need and/or without common belief based structure.

The Sovereign power of Lanka has developed through all those who believe that that land is their home – because they worked to make it so and/or sacrificed that which they thought was theirs to protect that home. Majority of them are no longer physically with us. But to the extent we believe in them as our ancestors they live with us and through us. THEY work the system.

Lanka existed before Buddhism arrived. Those who believe in those ancestors and/or respect them – invoke their powers which are stronger than Buddhist powers in Sri Lanka. Whether it is Buddhism, Hinduism, Islam, Christianity or Democracy  – they are all human forms of our belief. One who reaches the root of that religion would not recognize form and therefore the form differences. One who is conscious of money and/or status confirms that s/he is yet to reach the root of Belief.

Some victims of the current government have invoked the karma of war against this current government. If it were true that the pain of Sinhalese civilians - from the Tamil militants led by the LTTE was genuine and stronger than the pain caused by the government to Tamil civilians – then  Tamils would have demonstrated more pain during the covid-19 crisis. That is the way of Sovereignty and if indeed Lanka’s Sovereignty was strengthened by killing Tamil militants and civilians in their community – then the Navy would have shown the same rate of infection as any other civilian group. The true purpose of a group is the nucleus of its sovereignty. It can be invoked by a true believer in the whole which includes that group.

Buddhist partnership with Chinese is without belief in Democracy nor Buddhism.

In his Colombo Gazette  article ‘Buddhism, the Dhamma and politics; ‘All People Matter’, Raj Gonsalkorale quotes:

[Question posed to Venerable Mahinda as noted in ancient Sel Lipi, “Ven Sir, what would you say about the spread of Buddhism you brought to Sri Lanka from India? Venerable Mahinda’s response, “It has spread, but had not rooted”.]

China’s influence has spread and has not rooted. India has deep common roots in Lanka. On 13 June 2020 I wrote under the heading:

If Sinhala Buddhists insist on treating minorities as juniors – and Tamils invoke their ancestry the above would very well be a reality. This would mean that those above the border become Indians – as per our origins and those below the border become Chinese colony. Also – like those Tamils who fight to preserve the rights of the community being listed as LTTE Agents – the whole territory would be known as ‘Terrorist Territory’
