Educating our Educated Tamil CM ?

[So, Wigneswaran's new thinking which was reflected by his speech last Tuesday in Jaffna has well indicated that it had taken nearly four years, since he became the Chief Minister, to understand that the confrontational approach will only complicate issues further.] Ceylon Today article ‘Wiggy now thinks differently?’

During this period when awareness of Mental Disorders and the importance of ‘talking’ is being promoted by the Sri Lankan Media (for example Daily News article ‘ Mental Health: it’s nothing to be ashamed of’) it is pertinent to identify with the sources of our thoughts and mind structure through which we process them. As per my discovery, the two sources of our thoughts are:

1.      Internal - Our Truth
2.      External – Knowledge from the outside which is not yet Internal.

Internal
Our Truth includes our ‘habits’ which usually are not consciously processed through higher thought structures but operate directly through our biological / physical influences. These are animalistic in nature. There is nothing wrong with this so long as we do not claim otherwise. Winning the opportunity to govern is based on this ‘natural influence’. This facilitates self management in regular life. Hence the value of Cultural Diversity at the primary level of governance.

Truth at the Spiritual level is of absolute value and is realized by the self, independent of any physical influence.  Even one such person in a group would entitle the whole group to self-managing status. Saints are of this category.

External
External knowledge from the outside is also of two categories: Hearsay which is merely physical / what happened and when used without belief, amounts to copying / plagiarism. The more valuable external knowledge is through discriminative thinking using common measures. The wider the usage of the measure – the more common the users’ culture would be. By refusing foreign judges – the Sri Lankan Government is confirming weak investment in this area.

Truth on its own is neither right nor wrong. The measures used in a system make what happens and / or our thoughts right or wrong for that environment and for us as part of that environment. If what happened is genuinely measured differently by two groups – and such outcomes are expressed outside the local boundaries - they automatically become hearsay due to lack of common belief. The screening of ‘The Killing Fields of Sri Lanka’ by Ms Lena Hendry, in Malaysia,  to my mind falls within this category unless Ms Lena believed  herself to be more global than Malaysian.  A Sri Lankan Tamil screening it within her/his home area would be taken as expressing her/his belief which may or may not be within the law. Some of Gandhi’s work under British rule fell within this category. By accepting the punishment as per the law of the day, Gandhi restored the respect he was entitled to by practitioners of those laws. Such persons become kingmakers.

As per the above article:

[After his retirement from the Supreme Court, Wigneswaran was leading a very peaceful life focused on spiritual and cultural activities. It was on the insistence of the Tamil elites in Colombo, Jaffna and abroad Wigneswaran came forward to enter politics with the backing of the Tamil National Alliance hierarchy.
The illankai Tamil Arasu Katchchi (ITAK) Leader and Parliamentarian Mavai S. Senathiraja was considered the most eligible politico for TNA's Chief Ministerial candidacy. However, Senathiraja became a 'kingmaker' by supporting Wigneswaran to become the Chief Minister of the Northern Province.]

Indian leader the Hon Kumaraswami Kamraj also was a kingmaker. Such personalities have in reserve, Energies greater  than shown by their official status. Hence their ability to develop kings through Common Belief.

As per the above mentioned article:

[From the time Wigneswaran became the Chief Minister with his unblemished background in the legal fraternity, he genuinely voiced for the people affected by the war without any reservation or hidden agendas.
mixed reaction from political observers
Wigneswaran's firm stance in highlighting the grievances and seeking justice for the people victimized by the war led to a mixed reaction from the political observers, whether the outspoken Chief Minister's comments would damage the hard earned normalcy in the North and the East or would lead to amicable solutions for the problems.]

If the so called normalcy in North and East was hard earned – there would be no room for war-crimes charges. Like Gandhi, Mr. Rajapaksa also would have accepted the ‘punishment’ to confirm respect for International Law and the respect within his ‘home group’ would have also been strengthened.

In the case of Mr. Wigneswaran, his home-group at that time was largely the educated Tamil community in Colombo. To be able to represent Northern Tamils – Mr. Wigneswaran would have had to set aside at least some of his knowledge of Common laws applicable to all Sri Lankans and easily usable by the International Community. I myself had to do this at my workplace in Australian Public Service and at the University of NSW – for which I endured the pain of unlawful arrest and prison sentence. This helped me better appreciate the needs of Northern Sri Lankans whose thought orders would have been drastically shattered by the indiscriminate attack by the Government through the armed forces. The July 1983 riots in Colombo had the effect of pushing the more educated Tamils out of the official system. Some of them went into the ‘belief only system’ whilst majority lost connection with ‘Common Home’ and looked to form groups where those who showed commitment to winners of quick outcomes were allocated leadership positions.

Given that I felt comfort in going to the Tamil suburb of Homebush here in Sydney, when I felt let down by the official merit-based system, I expect Mr. Wigneswaran to have also felt that comfort when he went to Jaffna. I became more receptive to the pain of war-victims and this helped me appreciate the plight of Tamil Tigers when I worked with them through a UNDP project during ceasefire. Now I feel that this call from Sri Lanka came to help me complete my experience as ‘employee’ – to promote myself to the real position of employer / manager. Relatively speaking Mr. Wigneswaran did not have to give up employment opportunities to become Chief Minister of Northern Sri Lanka. But as a politician, he had the duty to give priority to belief over intellectual discrimination that he was used to as a Judge of the Supreme Court of Sri Lanka.

Governance of diverse groups in Northern Sri Lanka  does not get completed until  one develops higher Administrative structures on the basis of personal Truth as well as  knowledge used with respect for the source from which it is received. The latter was expected more of Mr. Wigneswaran than if Mr. Senathirajah had become the Chief Minister. As quoted by the author of the above article Mr. Wigneswaran confirms this as follows:

[We must evaluate our strength and our opponent's strength along with the strength of those who come forward to helping us. At the recent UNHRC session in Geneva we were able to understand the ground realities]

Mr. Wigneswaran has been delivering as per his difficult role but those who sought to make a ‘puppet’ of him would have been disappointed. The author of the above article confirms the ‘attitude’ of denial as follows:

[So, Wigneswaran's new thinking which was reflected by his speech last Tuesday in Jaffna has well indicated that it had taken nearly four years, since he became the Chief Minister, to understand that the confrontational approach will only complicate issues further.]
We say in Tamil that one / reporter who fell on the ground says that his moustache was not dirtied by sand! Some sink to low levels of politics and never rise above majority pull. We Jaffna Tamils have confirmed our higher mind-structure in self-governance through Mr. Wigneswaran also. One needs kingmakers to do this especially as minority power. Every person who sacrifices earned benefits and opportunities towards Common good – contributes to king-making. Want one? Come to Jaffna!

Common Caste Mind Order

Reconciliation is  presented as a key to the ethnic problem in Sri Lanka. But there are common aspects of the rebellion by youth on both sides to this war which pose the need for deeper research into the workings of the minds of Sri Lankans. Identifying with that Commonness would naturally eliminate ethnicity based excesses. Ignoring that commonness would internally transfer the problem from the more supervised side to the less supervised side. Presenting the wrong answers as the right ones leads to mental disorder as per the system of Karma.

Tamils are often blamed for suppressing their own lower castes. Hence caste is taken as an important classification of the structural order of our mind. Practice of Laws also determine our structural mind orders. Our mind orders often surface when we think we are in free environments – without supervision.

Given that caste was part of the Customary Law of Thesawalamai applicable to Northern Sri Lankans, it cannot be set aside as ‘evil’. When taken strictly on the basis of each person’s responsibility to society, caste often helps us to ‘position’ ourselves in public. It’s when the classification is used for ‘private’ / ‘selfish’ purposes that it becomes wrong. When wrongs are corrected within the environment in which they were produced – the damage is repaired. When they are neglected they become sins.

I was at the home of an LSSP follower. LSSP is presented as follows by Wikipedia:
The Lanka Sama Samaja Party (literally Lanka Equal Society Party…. ) is a Trotskyist political party in Sri Lanka.  At my friend’s place, my attention was drawn to the book ‘Revolt in the Temple’ by Victor Ivan who is presented  by Wikipedia as follows:

[Victor is an investigative journalist, political critic, a theorist, social activist and also an author of several books. He was the 7th accused of the main court case on the Youth Insurrection 1971. ]

By now I have learnt to identify with ‘natural connections’ as to why I am attracted to read something that I would usually not be interested in. In this instance, the mind of my friend who owned that home also was an influencing factor. When we are fully focused, losing consciousness of any returns from an environment – we connect to the mind of that environment, beyond the matter. To the extent my investment in my friend was genuine – that mind that so invested would merge with the mind at that place to form the True Common Mind of that place.

When I read the first chapters of  ‘Revolt in the Temple’, I learnt about the path of Karava caste which is presented by Wikipedia as follows:

[The "Karava" caste considered second in Sri Lanka was the specialist mariners/navigators also some of them were brought to Sri Lanka as Dravidian warriors throughout history, the "Salagama" caste has its origin in Kerala as "Saligrama Brahmins" who are even today considered as among the highest castes in Kerala & the "Wahumpura" descending from the Deva (mountain people) of the Mahavamsa. Even though ancient literature such as "Pujavaliya" suggests that the Buddhas might be born in Govi Kula, ancient Indians believed that Buddhas are born only in the kshatrya(Raja kula).]

The interesting Commonness between the leaders of JVP in Southern Sri Lanka and the LTTE in Northern Sri Lanka is noted by me through the following:

About JVP Leader:
[Wijeweera was born on 14 July 1943 (Bastille Day) to Patabendi Don Andris Wijeweera and Nasi Nona Wickramakalutota who lived in Kottegoda, a coastal fishing village situated in southern Sri Lanka and belonged to the Karava caste hierarchy.
In September 1960 he went to the Soviet Union and entered Lumumba University to study medicine. He completed the Russian language examination within seven and a half months, obtaining a distinction, and spent his holidays travelling through the USSR. He also worked during this time as an agricultural worker in the Moldavian Republic. He worked through his medical studies well up to third year and also obtained a distinction in political economics in 1963. In late 1963 he became ill and received medical treatment from a hospital in Moscow, but finally requested a full academic term of medical leave and returned to Ceylon. At that time the Communist Party of Ceylon was divided into two groups which were pro-Chinese and pro-Soviet. He did not get visa to return to the USSR as he joined the pro-Chinese group ] Wikipedia

About LTTE Leader:
[In the early 1970s, United Front government of Sirimavo Bandaranaike introduced the Policy of standardization to rectify the low numbers of Sinhalese being accepted into university in Sri Lanka. A student named Satiyaseelan formed Tamil Manavar Peravai (Tamil Students League) to counter this biased move. This group comprised Tamil youth who advocated the rights of students to have fair enrollment. Inspired by the failed 1971 insurrection of Janatha Vimukthi Peramuna, it was the first Tamil insurgent group of its kind. It consisted of around 40 Tamil youth, including Ponnuthurai Sivakumaran (later, the leader of the Sivakumaran group), K. Pathmanaba (one of the founder members of EROS) and Velupillai Prabhakaran, a 19-year-old youth from single caste oriented Valvettithurai (VVT).] Wikipedia

Most Tamils of Sri Lanka know that VVT is Karayar / Karava / Fisher folk environment.

I presented the following through my article of 24 March 2017, under the title ‘Christianity Development or  Post-War Development?’:

[Thiruketheeswaram's initial installment is credited to the indigenous people of the Manthai port, the Karaiyar Naga tribe.  The Karaiyar claimed to be related to several classical period public figures hailing from the international port town, including the creator of the oldest extant Tamil literature by an Eelam Tamilian, the Sangam poet Eelattu Poothanthevanar …………Under the rule of Cankili II, the king requested Karaiyars and Badagars in regaining back his kingdom. The Colonial Portuguese ordered Cankili II to surrender the Badagars and The king of Karaiyar (Carea) to be surrendered. Cankili II declared that he would not let the Badagars nor the King of Karaiyars to be surrendered, as they had come to his request. The Karaiyar troops aligned with the Thanjavur Nayak troops, and fought against the Portuguese in the conquest of the Jaffna kingdom. ]

Neither leader showed inclination towards higher education and therefore the mind-structure of academics – nor respect for the educated individuals within the community for whose ‘freedom’ they claimed to fight for. Both demonstrated the inclination to be warriors. LTTE’s is world known and they have been listed as ‘Terrorists’. JVP’s is presented as follows:

[It was April 9, Good Friday, 1971. Dr. Rex de Costa, a retired and decorated lieutenant colonel and a reputed medical practitioner, was at his quarters with his family in Deniyaya, down south. The day had just begun. The family probably hadn’t even sat down for breakfast. Around 9:00 a.m., shouts were heard from outside the door. A group of armed men ‒ all JVP insurgents ‒ had gathered, demanding that Dr. de Costa step out of the house. Not wanting to put his family in harm’s way, the ageing soldier opened the door. He had barely taken a few paces outside, with his wife cautiously peering from behind, when he was met with a hail of bullets. Dr. de Costa died on the spot.

Exactly a week later, in Kataragama, an Army unit had just rounded up a group of young girls believed to be connected to the insurgents. Among the girls was a local beauty queen named Premawathi Manamperi who had been named the Avurudu Kumari at the previous year’s Sinhala New Year celebrations. The lieutenant in charge of the unit ordered his men to get Manamperi to rat out her comrades in the JVP, by any means necessary. They tortured her through the night, but Manamperi just wouldn’t break. The infuriated lieutenant made her strip naked and paraded her across the town in the nude, beating and kicking her along the way with the help of another officer.] ‘The April Struggle’  at roar.lk

To my mind, when the Sri Lankan Government introduced ‘Sinhala Only’ law and  Tamils who had invested in Higher Education, felt the pain – those who elected the Government went down to the mind structure that suited warriors. The higher the mind, the greater the diversity that it includes. The Policy therefore promoted the insurgence in addition to paving the way for more Sinhalese voters to enter the University. The parallel of that is the University of Jaffna which is again facing separation of its Vavuniya campus (https://www.youtube.com/watch?v=BODFbfMbha8). Had the University of Jaffna raised its mind to the higher level – it would have not connection with  Vavuniya mind, which includes Sinhalese also.

The common reason is lack of investment in structure because we are distracted and driven more by ‘outcomes’. The former brings us a wife whereas the latter a mistress – even if one were officially and culturally married to the person. Likewise Government and De facto Government / Rebel. The latter is right only for outcomes.

The deeper we sacrifice the stronger our investment in common structure. We have a lady-relative who keeps claiming that she was entitled to take higher position than any of her siblings because she brought up her siblings after her mother passed away. That is like the rebels saying that they took the position of ‘opposition’ when the opposition in parliament gave up on itself / committed suicide. This lady invokes such power when she ‘sees’ in her little mind – the dollars and that the other side has and the obedience she thinks she would get from that sibling. When giving evidence in Court towards getting such money – the lady made this claim and the judge of the primary court included this as relevant. But one who has invested in the Common Structure would know that such a claim needs to be applicable to all beneficiaries – and each one as per their capability which cannot be translated in money terms by the claimant. Once the claimant confirms the influence of money – the claimant makes her/himself an outsider. To take higher position, one has to sacrifice earned benefits for the common good – as a mother does. One who claims only from one sibling / part of a community – is taking wife position and not higher mother position.

The lower the social value in terms of outcome, the lower the status of the producer – caste or no caste.  Leftists who indiscriminately eliminated the caste system based on such priorities – to promote communism distracted citizens from the path of Common education . Towards this they found the ‘gaps’ between  the Government and the Citizen – and as we say in Tamil ‘cycled between the gaps’. To that extend we need a Common solution and not reconciliation.

Pot calling the Kettle Black?

"Oho!" said the pot to the kettle;
"You are dirty and ugly and black!
Sure no one would think you were metal,
Except when you're given a crack."
"Not so! not so!" kettle said to the pot;
"'Tis your own dirty image you see;
For I am so clean - without blemish or blot -
That your blackness is mirrored in me."

The Sri Lankan Judiciary’s independence is yet again under Public scrutiny through the appointment of a Tamil lawyer to the position of High Court Judge. Immediate past  President of Sri Lanka states in this regard:

[Minister of Justice Wijedasa Rajapakshe had informed the Judicial Services Association that a certain political party had on an earlier occasion requested of him that Mr Ramanathan Kannan be appointed to the High Court – a request he had turned down. The appointment of a judge on a recommendation made by a political party would have struck at the very foundations of judicial independence. Mr Kannan has been appointed to the High Court over the heads of dozens of senior members of the judiciary and officials of the Attorney General’s Department. The Judicial Services Association has pointed out that if the need was to appoint a Tamil speaking judge for the North and East, the District Judge of Vavuniya D.L.A.Manaf would have been the most qualified candidate. Nobody would have objected if a Tamil speaking candidate of suitable seniority and competence had been selected for this position from within the judicial service or the AG’s Department.] the Hon Mahinda Rajapaksa – through Colombo Telegraph article ‘Irregular Appointment Of High Court judge Threatens Independence Of The Judiciary’]

One is reminded of the dismissal of the then Chief Justice Dr. Shirani Bandaranayake who was appointed by Mr. Mahinda Rajapaksa when he occupied the seat of Executive President of Sri Lanka. Was that dismissal Political or Administrative? One who is yet to admit that it was political lacks the authority to criticize his successor except through her/his Truth.

The Constitution of Sri Lanka provides as follows:

Independence of the Judiciary
Appointment and removal of Judges of the Supreme Court and Court of Appeal.
107. (1) The Chief Justice, the President of the Court of Appeal and every other Judge, of the Supreme Court and Court of Appeal shall be appointed by the President of the Republic by warrant under his hand.
(2) Every such Judge shall hold office during good behaviour, and shall not be removed except by an order of the President made after an address of Parliament supported by a majority of the total number of Members of Parliament (including those not present) has been presented to the President for such removal on the ground of proved misbehaviour or incapacity :
Provided that no resolution for the presentation of such an address shall be entertained by the Speaker or placed on the Order Paper of Parliament, unless notice of such resolution is signed by not less than one-third of the total number of Members of Parliament and sets out full particulars of the alleged misbehaviour or incapacity.
(3) Parliament shall by law or by Standing Orders provide for all matters relating to the presentation of such an address, including the procedure for the passing of a such resolution, the investigation and proof of the alleged misbehaviour or incapacity and the right of such Judge to appear and to be heard in person or by representative.

On the face of reported evidence, the appointment  of his honor Justice Ramanathan Kannan, is within the above provisions of the Constitution. Even the President does not have the authority to cancel such appointment through Due Process. It is NOT merit based appointment as per one’s credentials within the Administration of Law.

Mr. Mahinda Rajapaksa on the other hand considers seniority within legal administration to be the basic criterion needed for such promotion:

[Nobody would have objected if a Tamil speaking candidate of suitable seniority and competence had been selected for this position from within the judicial service or the AG’s Department]

But the above has no base in the Constitution. When on the other hand one goes to the dismissal process – outlined in the Constitution, one is able to appreciate the built-in mechanisms to protect the Sovereignty of the Judiciary:

(1)   Essential criterion to commence dismissal procedure   - Misconduct or Incapacity
(2)   Process must include: An address of Parliament supported by a majority of the total number of Members of Parliament (including those not present)
(3)   Notice of such resolution is signed by not less than one-third of the total number of Members of Parliament and sets out full particulars of the alleged misbehaviour or incapacity
(4)   Order of the President

The Independence of the Judiciary from the Executive is protected also through the absence of merit in legal Administration and/or technicality. The role of the Executive is to ensure that the Common structure on which the two branches of Governance are developed is not damaged by such appointment. Hence if the Bar Association and/or the Judicial Services Commission makes recommendations – the President has the duty to eliminate consciously all components of legal merit  based assessments. This places a ceiling on the use of Judicial Services to present cleverness. To the extent one shows cleverness beyond the needs of Public it becomes private and attracts ‘foreigners’.

When the President makes the appointment – it is expected to be as per her/his belief in the goodness of the person being appointed. If this belief is shared with other politicians or v.v. – then that satisfies the above fundamental requirement. A politician is taken to have acted as per her/his belief until known otherwise. Hence to the extent a politician and/or political party made the recommendation – that is well within the fundamentals of the Constitution. In Sri Lanka, when that person is of a minority race, appointed by President who is of majority race, it confirms independence through affirmative action. That was NOT the case with the appointment of Dr. Shirani Bandaranayake.

The dismissal process confirms the special need to protect the independence of the Judiciary by using merit basis as known to the Executive rather than belief which confirms independence. An action based on true belief is wholesome. It is a basic human right to be heard through belief. Hence the need for special parliamentary approval.

Friend or Relative?

A Sri Lankan visitor to Australia once said that only he knew why he was doing what he was doing. This to my mind was said to me because I disciplined the person saying that I would not tolerate words and actions that damaged the system I had developed within my Australian territory and known to be so by the other side. But often when people do not attribute credit to a person / structure there is no memory of the source from which they derive their current benefits. It is for this reason that we have family and institutional positions and structures formed by such positions. The problem with the above person was the confusion he had as to whether he was relative or friend? I had similar issues at the Australian workplace. I find that this is also the case with some Indian Tamil Political Leaders. As per latest news under the heading ‘MDMK chief Vaiko sent to judicial custody for pro-LTTE speech’:

[Chennai: A Chennai court sent Marumalarchi Dravida Munnetra Kazhagam (MDMK) chief Vaiko to 15 days’ judicial custody on Monday for speaking in favour of Liberation Tigers of Tamil Eelam (LTTE) in 2009.
Vaiko, who has been seeking early disposal of the pending case, surrendered before the court on Monday and refused to apply for bail. Consequently, the magistrate had to remand a judicial custody.
The MDMK leader who had been supporting the cause of Tamil Eelam (independent state for Tamils in Sri Lanka), in a public meeting in 2008, had alleged that the Union government was aiding the Sri Lankan government and warned that India would not remain a single country if the war against LTTE in the neighbouring country was not stopped.
The Chennai police in 2009 booked him for charges including the Section 124 A (sedition) and 13(1)b of the Unlawful Activities (Prevention) Amendment Act, 2004.
Tamil Nadu had witnessed widespread protests in 2008-09 during the last phase of Sri Lankan civil war and had asked the Central government to intervene to stop the war in the neighbouring island nation] Live Mint

The question we need to ask is whether Mr. Vaiko as an Indian Politician is a relative or friend of  the LTTE? It is important to remember that recently Mr. Vaiko also opposed the proposed visit by actor Rajinikanth to be the chief guest at the housing project ceremony organized  by Lycamobile whose owner is of Sri Lankan origin. That opposition was valid within his position as chief of a  Tamil Political Party in India. But there is no such position in terms of ‘telling’ Indian Union Government that India would not remain single country if it did not act one way or the other.

This kind of divisive mentality develops when one driven by quick outcomes is disconnected with the source of her/his status. In the case of the above Sri Lankan visitor – the most respected person in that branch of the family is that person’s father. One who disrespects that father and/or another person whom that father respected disconnects with the source of that relationship based power. In Mr. Vaiko’s case, the source of his current political position is the Union Government. If the Union Government and/or the Sri Lankan Government that is shown to be respected by the Union Government is disrespected by Mr. Vaiko – he loses the power of the source. To be like Gandhi, Mr. Vaiko must first set aside his official position which is part of the Indian Political Structure. One driven by Truth would do so and become an ordinary citizen and earns the deservedness to be supported by the Truth of other ordinary citizens. The fundamental value of Democracy and election of leader by the ordinary people is this power of Truth. A democratic leader has to become humble to share in the Truth of her/his People. As a Service provider s/he must have the respect of the beneficiaries – as parents need with their children, during grooming stages. One who shares through common belief does not need ‘shows of respect’ and one is within a structure has the responsibility to show respect where s/he is beneficiary of another’s contribution to the official position. Where there is common belief – both have the same experience.

If Mr. Vaiko had renounced the benefits of his relationship with the Indian Government through the State Government  his Truth would have sustained him and also benefited other investors in the issue – especially Sri Lankan Tamils. Those ‘free’ of official portfolios would represent each other as Equals. Hence the Commonness through sacrifice of earned benefits. Like friends – they are there for each other and protect themselves from ‘outsiders’ to that friendship and these outsiders may  include parents. Those who so attack – disconnect with the very source of the power through which they were juniors / minorities

To vast majority Sri Lankan Tamils, the Sri Lankan Government is a senior  relative. To those who attacked the Government the Government is a junior or equal  relative. Junior relatives have the authority to resist seniors through due processes of the common structure to protect their own positions. But they do not have the right to take senior positions through appointment - including self-appointment. They could be elected by a group as their Representative – as in Democracy. The LTTE was not elected by the People. Mr. Vaiko was. They are not equal relatives in Democracy.  Vaiko was merely a friend and not a relative to LTTE leader. When the two are  indiscriminately mixed they create disorder and mental illness. When the people are idle the leaders create autocracy in the name of defending democracy.

.As per current news reports, Mr. Ravi Jayawardene,  the son of  the first Executive President of Sri Lanka has passed away at the age of 80.

As per ‘news first’ report:

[Ravi Jayawardene who was the founder of the Police Special Task Force, was also a specialist in defence. Late Ravi Jayawardene worked as the Security Advisor to President J. R. Jayawardene, during the UNP regime of 1980 and he was also employed as a pilot for SriLanka Airlines]

As per Police Lanka report on this Special Task Force (STF):

This outfit was first deployed in the North to provide security to the Police Stations and to assist the Police to counter the terrorist threats. A section of this Unit was deployed in July 1983 to provide security in Wellawatte during the communal riots known as "Black July". The remaining personnel, who were serving in the North, were deployed in Point Pedro, Velvettiturai and Kankesanturai Police Stations in Jaffna District.

Wellawatte is Colombo 6 and is known as Tamil area. Given that the July riots in Colombo was against the LTTE by the Sinhalese, the logical pathway would have led to Tamil Police being employed in Colombo’s Tamil areas. If there were not enough Tamils within the Police Force – the Common Sri Lankan Police ought to have been deployed. STF was specially trained against LTTE. The borders of LTTE were forgotten and hence the attack on civilians – causing much harm. One who indiscriminately mixes family with workplace would tend to take the easy pathway of family and lose connection with the source of official power.  Until those in junior positions learn to  protect their sovereignty by staying within their position borders,  the path of democracy gets blocked at the entrance to Government.

If STF had shared Common Belief with Tamils – they would have included the LTTE as part  of themselves. Those without common belief are not of one family, community. Given that the STF was formed in 1980 and the LTTE sent the bodies of slain soldiers of the Government in July 1983 – one needs to ask as to who started the war? The above pattern confirms that the causal forces included the STF and that they did so for opportunity to ‘fight’ Tamils indiscriminately. This karma continued to produce the outcomes of 2009 war and with it the war-crimes accusations. It will continue until Truth is given form including through the Constitution.

As per Daily Mirror report ‘Broad agreement on power devolution’, released around the same time as the above report about the son of the first Executive President:

[Tamil National Alliance (TNA) MP M.A. Sumanthiran, who is privy to the Constitution making process, said there were areas already agreed upon.
“We decided to go ahead and finalise the interim report on that matters that have been agreed,” he said.
The Steering Committee has two full rounds of discussion on power devolution.
Mr. Sumanthiran said the Committee would meet on Tuesday, Wednesday and Thursday for further discussions on areas with consensus and work out the report.
“The matters still under discussion will be kept back,” he said.
However, he said Sri Lanka Freedom Party (SLFP) was not for the full abolition of executive presidency, and therefore it would be a matter for discussion later on.
“It is not opposed to the inclusion of devolution matters in the interim report,” he said. ]

Without the abolition of the Executive Presidency Sri Lankans who are yet to invest in true democracy would continue to invoke majority power in Administration and limit their mind-structures to their local areas. Their produce will not naturally be attractive to customers in wider markets. Hence, Mr. Sumanthiran’s previous message that ‘ The Tamil National Alliance (TNA) confirmed that they would guarantee a significant contribution from the Diaspora in terms of investments in the country’s economy, if the new Constitution solved the Tamil issue and restored confidence in Sri Lanka’   is already proven to be baseless. Like Mr. Vaiko, the Diaspora that ‘waits’ is demonstrating takeover mentality.

India’s Sai Baba, Jaffna’s Yoga Swami, Kandy’s Saint?

The other day at the gathering of Tamil Seniors here in Sydney I introduced Mr. Shiva Pasupati, former Attorney General of Sri Lanka, to a younger senior lady lawyer. My expectations as per my cultural mind-structure was for the lady to be happy to meet such a leader in person. But the lady did not even stand up despite all others in that group standing up. After Mr. Pasupati left the group I asked this lady whom I met that day for the second time – as to why she did not stand up? The lady promptly said that she was taught that ladies don’t stand up!!!!  I said to her that was Peethal Paranghi / Broken English culture. It is significant to know that this lady is a Catholic and that she did not practice law here in Australia. The lady is of Jaffna Tamil origin. If the lady had been a practicing Hindu of Jaffna – or if she had attributed credit to her legal profession of Sri Lanka for at least part of her current social status – the lady would have recognized Mr. Shiva Pasupati as her senior and shown respect. As per my interpretation – ladies are taken to be seniors until known otherwise and hence like the queen they did not standup to shake hands when introduced. I concluded that this lady had profited from the war and hence her migration to Australia. The lady herself did not have a firm structure through which to regulate her thoughts, words and actions. Hindus of Jaffna would pay their respects to Pasupati family and in Sydney particularly to Mrs. Isha Pasupati and Mr. Samy Pasupati who have been leading the activities of honoring Saint Yoga Swami of Jaffna. This is a strong foundation on which the Hindu Community of Sydney comes together through common Sri Lankan heritage.

Similarly Indian Guru Sri Sathya Sai Baba who is celebrated including by Christians and Buddhists all over the world. I have knowledge that most Buddhists of Sri Lanka commonly mention the Mahavamsa as the source of the Buddhist mind-structure but I have no knowledge of a Common Buddhist leader of Sri Lanka, accepted beyond her/his local area. Mr. Upali Cooray states in his Colombo Telegraph article ‘Sinhala-Buddhist Culture & Reconciliation’:

[The “Mahavamsa” or the Great Chronicle is said to be the main cause for “Sinhala Buddhist mentality” of the majority community which is supposed to have conditioned the Sinhala mind about their culture.
Mahavamsa which is not a part of Buddhist scriptures such as the Tripitaka. It is a poetic narration of Sri Lanka’s history by the Sri Lankan Buddhist monk Mahanama who lived in Maha Vihara Anuradhapura in late fifth or early sixth century. Naturally a Buddhist priest is inclined to give buddhism a prominent position though it is a chronicle on history of Sri Lanka he was compiling. Therefore It is not unusual for the chronicler to creatively include substantial fictional and mythical features but what is important here is many of the socio-political historical facts written in Mahavamsa have been established correct by other supporting evidence such as Epigraphs, and other historical data discovered locally and in India. The edicts of Asoka are the oldest, best preserved most accurately dated epigraphic records of India. The mystery of these epigraphs was unveiled by James Prinsep in 1837 who deciphered the asokan Brahmi scripts of epigraphs and identified King “Piyadassi”of the edicts with king Asoka on the testimony of Dipavamsa and Mahavamsa, in which the title Piyadassi was given to Asoka. There are many more such instances where Mahavamsa has been used to authenticate historical data discovered in India as well as Sri Lanka. ]

In other words, majority Buddhists of Sri Lanka do not separate Politics from religion.

It is important for us to note this at this juncture when the opinion of Tamil Political leader in National Parliament is reported by the Nation under the following heading:

‘Power sharing within a united, undivided, indivisible country – Sumanthiran’

Mr. Sumanthiran states during the interview:

[On the question of foreign judges, the wording in the UNHRC Resolution 30/1 on promoting reconciliation, accountability and human rights in Sri Lanka adopted on 2015 October 1, is very clear. It has separate categories including judges, prosecutors, lawyers including defence counsels and investigators.
Internationals are not mentioned in the said Resolution in the capacity of consultants or as those providing technical assistance. If the latter was the case, the Resolution would state such. The roles are instead specified. Any intelligent person can read and understand it. Sri Lanka co-sponsored the said Resolution not once, but twice. The second time involves the UNHRC Resolution 34/1 on promoting reconciliation, accountability and human rights in Sri Lanka. Both contain the same words. Whatever that is said by anyone to the contrary, outside the process, elsewhere, the two Resolutions, commitments are given to the world.]

The essence of the above Resolution could become part of UN’s Constitution. A reliable Constitution is a combination of who we have truly been until now and where we aim to be on the basis of our abilities and commitment to commonness.

To the average person, Reconciliation is the process through which one side understands why the other side did what it did, to produce ‘different outcomes’. The respective side’s outcomes when produced without supervision by any other would confirm their true Constitution.

The precondition is for each side to present their outcomes independent of the other and share why they did what they did when there is difference in outcomes produced under the same principles.  Towards this the two sides are taken to be ‘independent’ of each other, until known otherwise. Once known otherwise – the two become Unitary in structure and there can be no room for reconciliation. They are marked right and wrong under the one structure. The parties concerned become relatives and the  side that gets more rights becomes the Senior. When there is difference in interpretation, Senior’s interpretation is taken as right.  Where the principles are not the same then we are foreigners to each other – even when living within one territory.

Under a unitary state structure – two nations structure within one country is not possible. The simplest example through which we could relate to this is our own families. Under Unitary structure – the oldest couple / parent remains the common head of the family. The likes of Sathya Sai Baba and Yoga Swami are such examples of Hindu leadership in the Indian Subcontinent. The Hindu leaders in Thiruketheesawaram in Northern Sri Lanka state that the orders for their Catholic/Christian  parallels come from the Vatican. To them there is no local Catholic/Christian  leadership to provide subjective  leadership. I once read someone’s report that Chief Minister Wigneswaran’s instructions came from Australia!

Where children show outcomes independent of the parents – as the above lady demonstrated – it places a ceiling on the subjective leadership for that group – as happened in Sri Lanka through JVP in South and LTTE in North. In families – especially migrant families where the parents are ‘attached’ to their past – children often show independent outcomes – especially where they are ‘ambitious’ to be leaders in the new world. Where parents also appreciate this and keep their distance – the outcomes would be reconciled where the two outcomes are vastly diverse. That is the way of harmonious coexistence even though the two may seem as one family on the outside. Once children start producing their own outcomes independent of the parents – they become Equal and different to that extent. Parents who are attached to their past benefits would tend to cling to their old status and infuse fear in their children that they – the children would not get the full credit for their contribution – especially to the new culture that they are now part of. The solution is independence at the earned level.

This requires also some degree of separation at the physical level because seniors are likely to get hurt if disrespected by the juniors who are now independent due to producing their own independent outcomes without any reference to the seniors. When such seniors are killed / suppressed (mentally and / or physically) by juniors – it becomes a curse on the unit. When we as a community attribute credit to those who developed higher mind structures, we offset the effects of such curse. That is the significance of religion that is self-sufficient / sovereign in that part of the world during a particular period.

Through religious pathway, India of our period showed Sri Sathya Sai Baba and Jaffna showed Saint Yoga Swami. The more we surrender our earnings (money and status) to them the more we offset the effects of this ‘curse’. In Politics India has Gandhi during our period. Sri Lankans in Common have not identified such a leader.  Mr. Sumanthiran’s Political group has Mr. SJV Chelvanayagam as their Spiritual leader. But there is often no attribution  to this leader to confirm the subjective pathway. Effectively therefore the above statements by Mr. Sumanthiran are about his own cleverness. They do not invoke the power of those who sacrificed in their own way for ‘independence’.

Sacrifice of what we believe to be ours results in automatic development of Common structure that is available to all those who are bound to us by Common faith. Such common structures are the true bases that produce the laws that connect one part of the structure with another – and these connections are  known as relationships. Those who practice those laws would naturally work the system through the consolidated value of all those who contributed positively to that system.

Those who produce their own outcomes and have taken on leadership authority, are not entitled to lead the groups that follow the older leaders. The two are separated by time/age and are independents. Mr. Sumanthiran therefore has no authority to speak on behalf of  those who consciously or otherwise accepted LTTE leadership:

[The Tamil National Alliance (TNA) confirmed that they would guarantee a significant contribution from the Diaspora in terms of investments in the country’s economy, if the new Constitution solved the Tamil issue and restored confidence in Sri Lanka. TNA MP, Attorney-at-Law M.A. Sumanthiran made these statements in an interview given to the Nation. He further added that the Diaspora was keen in doing so.] – Nation article - TAMILS AWAIT THEIR DAY – SUMANTHIRAN

Mr. Sumanthiran is officially not a member of the Diaspora. Hence he does not have the right to speak on behalf of the Diaspora, except as part of global community including through religion. Those of us independent of the TNA and other Political groups have been investing in Sri Lanka for a long time – including during the war – through the gaps created by ceasefire – official or unofficial. Family  uses barter system and not money. A Family that users money / economy as the yardstick – confirms lack of Commonness.

Investment  of money without policy is Expenditure and would lead to disorder – not only through young ones but seniors who now have more money in their hands than they did back in Sri Lanka and hence disturb the old structure through which we invested to become who we are today. Many of these seniors in the Diaspora would try to be the bosses of Sri Lankans of their age or even older than they. If the monies are invested through structures that fail to demonstrate global standards – they would form coalitions of disorderly structures in Sri Lanka – including within Government circles. The Lycamobile saga in which Indian cinema superstar Rajinikanth was involved in relation to housing aid is an outstanding example of such disorderliness. As per the latest news -  Lycamobile is suing Sri Lankan Member of Parliament – the Hon Charles Nirmalanathan for linking Lycamobile with former President of Sri Lanka – the Hon Mahinda Rajapaksa. As a politician representing Vanni District in National Parliament, the Hon Charles Nirmalanathan is entitled to express his belief on behalf of his people. Given that Mr. Rajapaksa is also an elected member of National Parliament – such links could be classified as baseless but not defamatory. If on the other hand one was linked to the LTTE which is officially classified as a Terrorist organization – and it is not factual – as has happened to me many times – especially by Sinhalese – then there would be grounds for defamation. Then again there are jurisdictional issues where the statements were made in an area not covered by the jurisdiction of judges – as in the case of ‘foreign judges in relation to war-crimes’. Yet during his interview with Nation Mr. Sumanthiran failed to take a stand on this:

Q: There have been various views on the cancellation of the visit to Sri Lanka of actor, Rajinikanth. What is your view?
A : I have no thoughts on this matter. It has nothing to do with our politics.

If the above is a true reflection of Mr. Sumanthiran’s mind – then money brought into Sri Lanka through Mr. Sumanthiran’s influence – is likely to be without a common base. Post war housing construction is very much a Political issue. Easy money often promotes disorder due to wrong leadership.

The example that comes to mind is that of my sister in law who was primarily a home-maker and left it to me and my husband to sponsor her family to Australia, but wrote directly to Barclays Bank in London on the basis that she was the eldest who took her mother’s place when the mother passed away. The lady did not attribute credit to her father who was the one who made the sacrifices to develop that family’s structure. Also – during that time – responsibilities of sons and daughters were separated and a daughter cannot claim status over a son in ‘External status’ issues. Even mothers do not have that authority beyond the local family borders.

As per the local laws of Thesawalamai that the family is bound by – the sons inherit the father’s position to represent the family. But this home-maker overrode that protocol once she had Australian pension in her hands. This happens when our conduct is outcome based – as in majority power. That is animal / asura culture which is also within us. So long as we stay within those boundaries – and not damage higher structures through majority power – we would not invoke the curses of saints.

The reason for excessive, unjust use of majority power is indicated to be in the genes of majority race in Sri Lanka and those who reacted to them. Mr. Upali Cooray reveals this as follows:

[I was watching in dismay the other day, how one of the participants on a TV talk show analysing the well known story, the origin of the Sinhalese; the story of “Sinhabahu”.
As the narrative goes briefly, a Lion King cohabitated with a royal princess having imprisoned her in a cave in the jungle and had two children by that relationship. Then the grown up son, Sinhabahu rescues the mother and the sister by killing his Lion father and cohabitates with his sister. King Vijaya, who is the progeny born out of the Lion killer prince Sinha Bahu’s relationship with his sister, Sinha Seewalee, is said to be the first Sinhalese who arrived with his entourage in Sri Lanka. A son born by the cohabitation of a brother and sister. That is how the story goes. Vijaya is supposed to have been banished from India with his followers on grave crimes and aggression against people in India
According to this talk show participant, the Lion king a beast living with a human female is “against the law”(Neethi virodee). He did not say whether it is the current law or the law in the era they lived which is applicable!. Secondly, he claimed it is incest when sister and brother cohabitates. Therefore the Sinhalese should be ashamed of their origins. Rationally correct. This be will be commented on later in this piece.]

If  Lion and Tigers are leaders respectively – it would be natural for those groups to be limited to that level of civilization. Majority power leads to that structure of the animal kingdom where there is no bar to biological parents enjoying pleasures with their children. It is still not unlawful in most countries for people with vast age-gap to marry each other. It’s the mind that sacrifices the physical and the immediate that naturally develops the higher structure and earns the higher position. In the animal world all that seems of the same size/structure  are taken as Equals. Others are foreigners.

Sinhalese-Buddhists  need a Buddhist leader of Sri Lanka, who so sacrificed, to have the blessings of  Article 9 which entitles Buddhism to be the foremost religion. Then they naturally set aside the system of democracy to that extent. To the extent they take the Mahavamsa directly and produce outcomes independent of such leadership and those outcomes are diverse – they form their own nations. In the meantime – if minorities share through Common Leader – spread their territory and form – for example – Tamil Nation; Sai Baba Nation and Yoga Swami Nation. The higher the mind the broader its reach. Minorities have the advantage of small group focus in the privacy of which the mind is steadied and raised to the higher level. But those distracted by majority power would tend to confuse matter with mind. That’s the lesson to be learnt by both sides to the Sri Lankan war.

Racial Discrimination Act 1975 – Foreign Law to Sri Lanka?

We have been receiving messages from Community leaders of diverse cultures regarding the Government’s defeat in relation to Section 18C of the Racial Discrimination Act 1975 which states:

RACIAL DISCRIMINATION ACT 1975 - SECT 18C

Offensive behaviour because of race, colour or national or ethnic origin
 (1)  It is unlawful for a person to do an act, otherwise than in private, if:
(b)  the act is done because of the race, colour or national or ethnic origin of the other person or of some or all of the people in the group.
Note:          Subsection (1) makes certain acts unlawful. Section 46P of the Australian Human Rights Commission Act 1986 allows people to make complaints to the Australian Human Rights Commission about unlawful acts. However, an unlawful act is not necessarily a criminal offence. Section 26 says that this Act does not make it an offence to do an act that is unlawful because of this Part, unless Part IV expressly says that the act is an offence.
             (2)  For the purposes of subsection (1), an act is taken not to be done in private if it:
                     (a)  causes words, sounds, images or writing to be communicated to the public; or
(b)     is done in a public place; or
(c)  is done in the sight or hearing of people who are in a public place.
             (3)  In this section:
"public place " includes any place to which the public have access as of right or by invitation, whether express or implied and whether or not a charge is made for admission to the place.

The amendments proposed to the above were to replace some words as follows:

[The Government had wanted to replace the words "insult", "offend" and "humiliate" in section 18C of the Racial Discrimination Act with the term "harass".]

‘Insult’, ‘offend’ and ‘humiliate’ are relative to the victim and need to be measured on the basis of measurable ‘losses’ and/or pain as certified by a mental order specialist. Harass on the other hand is more provable through majority manifestations of the said conduct. Hence a politician driven by majority power, wanting to elevate her/his status with the electorate would find harass more favorable due to the likelihood of such actions being in the minority with Australians being conscious of  their status as managers of international affairs rather than being managed.  Victims and their representatives in Parliament would identify with the loss of opportunities for them to get compensated and/or share  the pain and/or loss due to what they believe to be racial discrimination, with others. If the existing words make it difficult to prove racial discrimination, the proposed change would have made it even more difficult to do so.

Pain is personal to the person with experience. The victim has the right to describe it as per her/his belief – until proven otherwise. I described it as per my belief and despite the evidence highlighted, I was dismissed by the Australian Federal Court as well as Supreme  Court of NSW.  In one instance my submission heighted the following evidence:

Gaja Lakshmi Paramasivam v State of NSW  at Federal Magistrates Court SYG 584 of 2007

………………………………
At the end of yesterday’s proceedings, the Respondent submitted Police Business records marked ‘C’ (exhibit 11)  which states:
Country of Birth              -       Sri Lanka
Country of Birth – Father    -  Unknown
Country of Birth – Mother    - Unknown
Place of Birth                   -      Sri Lanka
Nationality                       -       Sri Lanka
I now produce its parallel as produced by me and published by Commonwealth of Australia (passport).

As per my  evidence that Business Record would have read like this:

Country of Birth              -       Sri Lanka
Country of Birth – Father    -  Sri Lanka
Country of Birth – Mother    - Burma
Place of Birth                   -      Jaffna
Nationality                       -       Australian

As usual the above record was not taken as confirmation of Racial Discrimination back then. But due to the opposition to 18C the following surfaced in the newspapers to confirm to me that I was a pioneer in defeating such negative forces in Australia:

[Ejueyitsi v Commissioner of Police (Western Australia), 2013 — UPHELD
An African man complained he had been humiliated and intimidated in a public space when he "was arrested unlawfully handcuffed and detained and his clothes were stripped off".
He also alleged a police officer said to him: "I am going to deal with you, you bloody African".
A federal magistrate upheld the complaint.]- Section 18C: What racial vilification complaints have been upheld, dismissed by a judge at http://www.abc.net.au/news/2017-03-21/18c-racial-vilification-complaints-upheld-and-dismissed-in-court/8374284

When we are able to identify with our contribution to such major changes in attitude – we get ‘even’ with the evil side of the system. If wrongs are not corrected with their due period they become sins. These sins find their own media to manifest actions not controllable by individuals and private groups and often by governments as in Sri Lanka.

My question now is whether to the Australian mind, calling LTTE Terrorists while JVP are mere rebels – also amounts to racism? If no – then Australians working at management level in Sri Lankan affairs – are not eligible to hold those positions, leave alone the Hybrid Court Judges’ positions. If yes, they are already part of the solution – with or without the official status and the publicity that goes with it.
Truth never fails a true believer who upholds her/his sovereignty even during most painful  experiences.

In Sri Lanka, Disabled Soldiers are claiming that they were doing their jobs and were not driven by patriotism when they fought against the Tamil Tigers. Sunday Leader article ‘Disabled Soldiers Demand An Urgent Solution’  If  the soldiers believed that they were fighting to protect the Sovereignty of Sri Lanka – that alone would have been sufficient reward for their efforts. By demanding disability pension, they are confirming that they were in the war for a job. This denies any politician to claim that these soldiers were protected by their belief from being charged for breach of laws of armed battles. True belief alone can provide such protection. A leader to claim such protection on behalf of her/his group – s/he must be bound by Common Belief with the ordinary members AND the members must trust the leader to speak on their behalf. When the members claim job related benefits – through Public demonstrations – the leader is no longer entitled to claim confidentiality that comes with Common Belief. Hence, scientifically speaking – law abiding Sri Lankans want war crimes inquiry – thanks to the disabled Sinhalese soldiers.
